  1. In ATX as long as you can create a PDF to attach with the efile forms then you can have it signed for the partnership by the representative, and then I presume you would follow through with a similar statement on the individual partner returns to complete the cycle of claiming the QBI.
  2. There is an election statement on the Elections form specifically for this Sec 199A rental situation. Have used it a few times in the last couple of weeks. You need to print it out, get it signed, create a PDF and attach to the efile forms for filing.
  3. NECPA - get the POA and have it ready to fax to the IRS. I dealt with this issue last year, and although it took us several months to resolve, the IRS will talk with you and help you through the process. You will need patience and maybe have to dial up the ID theft phone number several times to just get through - but they will (despite Jack's quote) talk with you once you fax them the POA. You will most likely have to paper file the return and attach a Form 14039 with that return.
  4. JJ - as KC noted before, don't give up on the disability issue. My wife and I went through that on her behalf several years ago - and managed without an attorney. It took nearly 30 months from start to finish. The path here is designed to get you to give up. Rejection is the government's way of driving you to give up. Don't do it. And a final thought - if you can get your wife's doctor on board to write a very thorough letter describing her condition and its prognosis you are a step up. Then ask the doctor to attend the ultimate hearing you will have before an administrative judge and you may find it is easier to win than you thought. And the bonus on top of the retroactive dollars is you can get her on Medicare immediately if you are more than 2 years past the date designated as the start of her disability. God works in very strange ways as we can attest to. Will pray that He can lead you through this and allow you and your wife to reach a better solution. God Bless !

    K-1 from LP

You have suspended losses from a PTP and it just carries over on the worksheet till next year or when you have profits or sell the activity. Nothing should go from this to 8582. When you sell it the suspended losses (if the proper boxes are checked at the top of the input screen) will flow to page 2 Sch E.
  6. A properly computed Net Operating Loss should be shown on line 21 of Form 1040. There are other items besides just a Sch F loss from a prior year that would go into the amount of any NOL carryover. And did the taxpayer elect to carryover the loss rather than first carry it back on the prior year return.
  7. Will check it out. Client now also tells me that he at least got an "electronic filing pin" number. So interested to see what that brings. Thanks for your input.
  8. Has anyone seen a letter from IRS asking whether the taxpayer has filed a Form 1040EZ - and a box to check that says "NO-I did not file this tax return". Goes on to request you call them or fax them further information. Letter is not a notice but shows "OMB Clearance No. 1545-0074" and reference "Ltr 12C" at the top of page one. Return fax address is to "Attention: ICO Rejects Team - AUSPC" FAX # 855-204-5020. My client has not filed their return yet but does have significant estimated tax payments made during the year that I am concerned about. It sounds like someone, who has obtained a valid SS # in this case, may be filing a false return trying to claim refunds. Client has attempted to contact the IRS but ends up with "due to the high volume of calls, we cannot help you at this time, please call back". We should have this return ready for efile by end of the week and most likely will have overpayments that are planned to be applied to 2015 estimated taxes. Any suggestions on what else we should due at this point would be appreciated.
  9. The $200 and $500 amounts both apply to the "De Minimis Safe Harbor Election" and that is the 1.263(a)-1(f)(i-ii) one. They both fall under the same code section so there are not separate elections. Your accounting policy could have both amounts or not. They are annual and do not require a 3115. The "Small Taxpayer Safe Harbor" is the 1.263(a)-3(h) and that applies to eligible building property whether owned or rented. The Form 3115 requirement comes in relation to the new definition of "units of property" and various other new descriptions in the regulations. So even if you feel, as I generally do, that my clients are not actually making a change in the way they account for all of these costs; it seems you still need to file for a change since these items or terms did not previously exist in the Code so going forward you need to adopt them to protect yourself and your clients. Just a lot of effort to kill some trees, paper your and the IRS files, and generally drive everyone crazy during the coming months. Thanks IRS !!!
  10. Getting back to the original of this segment - according to word from my ATX rep the MAX package at least will contain a "printed copy of MTG". So I am expecting to receive it in print !
  11. Version 12.19 is not liking my old XP machine at all. Afraid to try to put it on my Win 7 hummer at this point. It keeps crashing just trying to open a return, I have not tried to add the organizers for my testing. Has anyone tried .19 on an XP machine with success??
  12. Would be very interested in hearing your thoughts - [email protected]
  13. Frannie - "we wanted a low cost program" with any capabilities. I did not request any real changes except for in the client letter edit ability - and they solved that, now I can't edit even that. As rfassett says it seems that no one is having the exact same problem, from speed to opening to rollovers to shutdowns - we all want ATX to succeed and be there. But it seems pretty obvious to me that they were ill prepared to release this product when they did and they apparently did far too little beta testing and have no backup plan which could offer a solution for their many users. And doing this major shuffle and giving literally no advance notice to the user base is what causes many of us to "complain" about what is going on. For many this, as for you, is a vital part of their financial existence and therefore it is critical when we have spent money to expect that the product will perform at least in a limited fashion.
  14. I'm confused - I find the "Backup" in ATX but there is nothing in the folder. I search for "database" in the program and find nothing. Is this another change by ATX to make me crazy. In prior years I just backup by "database? folder to an outside source, but in 2012 I cannot locate the "database". Any help or directions would be appreciated.
  15. Taxed - if their in a custody battle how is filing early going to stop the boyfriend from still trying to claim the child and you get the IRS involved with something your client needs to resolve before you file her return !
  16. I am in real trouble since ALL of my client letters are customized. I build my own paragraphs and such early in the season and then just load or delete those for each return as I go. So I too am distressed with CCH-ATX and the changes they have made to "improve" the program. I wonder if the new platform they have built the program on will not allow some of the things such as editing letters, forms, use of spreadsheets into the program. Those are the things that made ATX so workable for me and my client base. UGH :dunno:
  17. Medlin - while I am sure you can see both sides I suspect that you would not put out into the public realm (your customers) a program that does not function. I am not talking about being slow or not having all the bells and whistles right up from (being worked on) - but rather a software product that has performed very well and adequately for a long number of years, but now you have determined that you need to change the platform and along with that, eliminate some of the most basic features that many of us "customers" use. Well that could be fine except the product that you ask us to pay for in advance and then you deliver in early December does not work. It is not the forms for IRS, it is the programming. And along the way you did not bother to mention to us "customers" that you were planning on doing such radical changes during a time frame when we could have considered making some changes if we did not agree, but NO you just dumped a heap of crap on our desks and now you "CCH" have been unable in nearly 6 weeks to revise and improve it to where one can at least open the program to see what you may or may not have done. Why would you do that, why would you not thoroughly test the changes out, and why would you not inform your customer base ahead of time. Seems to me to be a business plan that is doomed to failure. Of course I can't see the other side right now, I am trying to figure out whether I can survive the tax season that is upon us !!!
  18. Well since all my client letters are modified maybe that is why I can't even rollover to open a return. JB does Lenny have any tools to fix PC software with?
  19. The only thing I am stockpiling right now is a lot of anger and frustration. And I have no idea what line to enter that on since I can't open a return yet !!
  20. Well what can I say, I am really disappointed now. Just today got my Express Answers book from ATX and they don't have anything in it about how to make the program run. Now what can I do??
  21. Well with all the changes, testing and so forth - and "performance optimizations" - will I actually be able to rollover or open a return just to look at it ??????
  22. Deb - I have done that although I do not get a second box popup when I choose to run as administrator. I can open the program either with or without the administrator idea and do some basic stuff like Preferences - but if I try to open a return or rollover then up pops SFS has stopped and out we go. Appreciate you help.
  23. I have installed this on another computer, also with Windows 7. Net results are the same as before. Now after deleting and reinstalling the program about 4 times on my server I can open the program and go through the various functions until I try to rollover. I have gone in thru ATX 2011 and opened and closed several returns as noted in other comments on this forum. However, I still cannot rollover any return - it now gives me a note that "SFS program has stopped working" and then it closes down when you hit okay. I am on version 12.1.1226.1 I believe it is which is apparently the latest version out as of today and so far still unable to actually rollover or open a return. Are there any other possible options anyone has found in order to actually rollover or open a return.
  24. Using Windows 7 and it is updated constantly. Working on getting another computer to put it on - normally only one unit in use.
  25. After talking with Support and downloading their "update" I still find I am unable to use MAX. Program opens, I am unable to perform any functions, and within approximately 1-2 minutes the "shell.loader.exe" Shock message appears and program shuts down. They tell me I now need to wait until the next update to hopefully solve the issue. Anyone still fighting this problem and has anyone found a recent solution?? Thanks - rant is growing inside !
