My client has received a 1099R with a distribution code L1 because her prior company closed down her 401(k) plan while she had a loan outstanding. She didn't pay it back and because she is under 50 years of age, it appears that she will have to pay a 10% penalty as well. I have researched the instructions for form 5329 and find no exceptions that apply. Has anyone had this experience in the past and aware of an out for the penalty? Thank you.

Maybe you are living right, Margaret, but I think I must be as well. All of the complaints on speed and crashes and the like are baffling to me. I just have a standalone operation and would be considered a small volume operation. Honestly, I have none of the noted problems. I am not a cheer leader but it seems like almost a virus with all the complaints. It goes from bad to worse. Sorry, I will get back to work; I don't think that ATX had its best year but it definitely has picked up the pace. No righteous indignation here.

I guess I am one of the "lucky" ones using ATX. I haven't had any opearting software or computer issues for over two weeks. I am not doing any particularly chalenging returns but I don't feel that your problems apply only to complex returns. Just my two cents. Hope thing get better for those of you with big problems soon.
