schirallicpa
I am waiting for a grumpy older lady to send back the signed efile form. She has already received her executor fees and doesn't want to do anything more. She lives a distance away so the forms were mailed to her. The attorney does not have authority to sign as executor. I'm kinda stuck between a rock and a hard place. Not sure how to convince her to sign papers and don't know what alternative I have.

grandmabee
You might want to point out to her if the return is late she is responsible to the it out of her own money. Hopefully she saved money to pay you before distribution.
Bart
You might point out to her that as long as the estate is still open (and it cant be closed until she signs so you can file the final return) there could be claims against the estate that she might have to pay if the estate has no money.
Roberts
https://www.fiskeco.com/executors-can-be-personally-liable-for-unpaid-estate-taxes/ Failure to file can earn penalties from the IRS that the executor is personally liable.
