However, his former wife died in 2021 - so he could also file mfj with her?? He does get back more money as 1 child and not QW as not been a year she has been deceased. Lion EA Posted March 18, 2022 Report Share Posted March 18, 2022 No. He can no longer file with a former wife, dead or alive, once he marries a new wife. His 2021 filing status revolves around his status 31 December 2021. If he was married to new wife 31 December 2021, his choices are MFJ with new wife, MFS with her as spouse, and possibly H/H if he qualifies.
