Marie
I applied for an EIN for a deceased individual's revocable trust. I marked revocable, put in date of death and got the number. Now the letter that I printed on line says form 1041 needs to be filed on 12/12/2022 (that's the day I applied for the number) And after review they determined I needed to file tax returns as far back as 2010. How do I fix this?
Lee B
"Trusts should enter the date the trust was funded or the date that the trust was required to obtain an EIN under Regulations section 301.6109-1(a)(2)." I believe you have to mail a letter explaining what needs to be corrected. Address should be enclosed with the mailed EIN letter received from the IRS or an online search will pop up the address. Marie
ok thanks. can we go ahead and use it while i'm changing it
Lee B
The EIN won't change. Unwanted complications may arise due to how long it will take for a correction letter to be processed versus when the trust return is filed.
michaelmars
Once the person dies revocable trusts end and they usually become irrevocable.
