  1. If you are in a construction union with a union pension plan, is that considered having a pension plan when IRA contributions are being calculated? All of his w-2's, and there are many, and not the same employer from year to year, do not have pension box checked.

    Each individual employer pays certain monies to the union toward his benefits, but does that prevent him from funding his own IRA?

  2. It's not in the wrong place on the W-2, it's that the state of NJ has several options to put these items on the w-2 and one option is that the additional items may be placed in the area for local wages and amts. w/h'd. You can find this on the NJ tax website.

    Many persons have NJSUI, NJTD, NJFLI, Sec125, 414H, all of which won't fit in Box 14, so they slop over to the area for local wages,etc.

    And of course if you have trouble with this "See your local tax preparer". ;-)

  3. Publication 17 for 2011 specifically states that qualified education expenses do not include:

    Room and board, insurance, medical expenses (including student health fees), transportation, or other similar personal, living, or family expenses.

    It goes on to mentions other things, however the answer to your inquiry is above.

  4. According to radio reports, a small private plane flew into the IRS office in Austin, TX today.

    A individual who may be related,(unsure), said that the pilot, who she knows, burned down his house last night. She also says his plane is missing from the airport, and his car is parked at the airport.

  5. According to what I read on that link I sent, You don't have to file if you made less than $1000, unless you are chasing the refund.

    There are several reciprical states that are handled differently. You didn't mention student's state of residency.

  6. Hi YardleyCPA, this is BobinNJ (actually Freehold, but spend alot of time in Trenton)

    Do you have a copy of the will? It should tell you if there is a residual beneficiary, or if both are to be residual beneficiaries. If only one, then only one

    k-1 will be necessary and all the income/losses will be on that one k-1. The Will dictates.

    I don't think funeral expenses are deductible on the estate return, and they are certainly not deductible on the final return of the decedant, which you did not mention.

    I am assuming that this is a PA resident, not NJ? I have never done a PA estate, so any state ramifications, you're on you're own.

  7. After much prodding, client finally presented return info during late March, 2008. (a disregarded entity LLC)

    Return resulted in overpayment of $6340 which was applied fwd. to 2005. Return was mailed on 4/14/08 and now IRS has notified that money will not be applied to 2005 because return was not rec'd. by them prior to Three Year Rule limitation.

    Is there any way that this can be appealed? Anyone ever gotten relief in this situation?

  8. I have a client who turned 70.5 in 1996. She has an IRA. She did not take any distributions on 1996-2000. She took enough distributions in 2001-2005 to cover the minimum. She did not take any distributions in 2006 or 2007. What do I need to do to report this and make this situation right?

    First, I would suggest that your consult Publication 590 in the areas of MDR and the possibility of 50% penalties for years not taken.

  10. Any one else experiencing entering K-1 for NJ and not having them show up on the NJ 1040 return. I'd had to manually enter the info. Caught one before I let it out of the office. I am going to suggest to ATX that they may want to look at this situation. Big chance that will be corrected.

    Were the K-1 figures positive or negative? Cause negative figures won't flow because of the Gross Income tax system in NJ, as you probably already know.

  11. So the various counties don't each have their own forms? I'll call them tomorrow, thanks for the tip.

    If you go to www.revenue.state.pa.us/ and click on Tax Professionals then Local Taxes, you will be able to get lots of specific info including adresses and people to contact in each municipality, cause most of these local taxes are not counties, but towns. It is my experience that they run these offices like little fiefdoms, and won't refund anything unless the employer gets involved.
