  1. All returns I efiled yesterday and today are labeled as "Transmitted to EFC". I called helpdesk and the machine says that there are no records on some of my returns.

    No acks here either. What to do? I have one guy that is a paperwork freak that is waiting on me to mail him the acknowledgement.

    Been a partnership for over 12 years. Always been due 4/15.

    The tax year ends 12-31, so due date is 4-15.(or am I still in crazy world?)I am filing an extension - can't please everyone.

  3. Client comes and and informs me that, in 2009, he and his brother formed a

    Domestic LLC. They are buying and renting out homes.

    I think I'm looking at a partnership here. But, being pretty new to me, I'm confused.

    I have the articles of organization as well as an operating agreement between

    the two brothers.

    Line 1.1 of the agreement states:

    The Members form a LLC ("Company") pursuant to the Act. This entity is not a

    corporation, general partnership, limited partnership, or joint venture,

    and no member or manager shall be construed to be a partner or shareholder

    in the Company.

    My first instinct is the 1065 and 8825. Am I wrong? Am I crazy for agreeing

    to this on April 14th?

The need to file amount applies to gross income from all sources except tax-exempt sources such as social security; once the threshold is met, then you determine federal agi and attribute that to Virginia as appropriate to determine the amount of tax for the individual. It sounds like you are on the right track with what he is getting back.

    Federal AGI.

  5. Ahhh..ok. I get 64%. So, does it matter that my VAGI (line 10) is in the "need to file" catagory even though the actual amount of VA income isn't? Would I just complete the form and ignore the

    fact that the VA income is actually 7336.00 and not 11424.00?

    Really, he should just be filing to get the VA state tax back (197) but now he'll only get like

    83.00 back.

    Am I making any sense? :scratch_head:

  6. Client is a MI resident who worked in VA for a while (job sent him there) and this is reflected on his w-2...BUT now I have a problem.

    W-2 Info

    Box 1 Fed Wages 11424.00

    Box 15 MI Wages 11424.00 Box 17 MI Income Tax 294.18

    Box 15 VA Wages 7336.00 Box 17 VA Income Tax 197.37

    I want to prepare the VA Nonresident Form 763. While reading the instructions, it states that you do

    not have to file a return if your VAGI is less than 11250.00. Just file to get the refund.

    Instructions for Line 6 - enter the total amount of your federal adjusted gross income from your

    federal return. This would be the 11424.00, which makes his VAGI in the "need to file" catagory. But according to the w-2, his VA wages are only 7336.00, which would put him in the "do not need to file" catagory. I can't find where I can make this correction on the tax form. And you have to attach the Federal return to the VA return, so I have to show the AGI from the Federal.

    Am I missing something? Or any ideas? Never did one of these before. Thanks!

    Q. Can a taxpayer claim the first-time homebuyer credit if the purchase is pursuant to a seller financing arrangement (for example, a contract for deed, installment land sale contract, or long-term land contract), and the seller retains legal title to secure the taxpayer's payment obligations?

    A. If the taxpayer obtains the "benefits and burdens" of ownership of a residence in a seller financing arrangement, then the taxpayer can claim the credit even though the seller retains legal title. Factors that indicate that a taxpayer has the benefits and burdens of ownership include: 1. the right of possession, 2. the right to obtain legal title upon full payment of the purchase price, 3. the right to construct improvements, 4. the obligation to pay property taxes, 5. the risk of loss, 6. the responsibility to insure the property and 7. the duty to maintain the property.     The divorce decree only says Mom has to cooperate, not that she has to take any specific action such as releasing the exemption. Anyway, one of the easiest ways to get around that is to arrange for at least 50% of the child's support to come from third parties such as the new boyfriend. In that case the 8332 is not only not necessary, but not even legal. Can your client prove that such support does not exist? Or suppose Mom arranges for the child to stay with Grandma a lot, so is not a qualifying child living with Mom more than half the year. Then she can cooperate by demanding Dad sign any forms necessary (like monthly checks) to pony up more than half the total support, which is the only way he could claim a qualifying relative--and HE will have to cooperate or face contempt charges!

    Jainen - sometimes things ARE as they ARE. You are creating ideas and situations when, well, this is a simple "it is what it is". Where did that come from? I never mentioned a new boyfriend. And I never said Dad was behind on any child support. All is up to date. My question was in regards to what the divorce decree stated.

    The Plaintiff, (client name), shall have the right to claim the minor child for tax purposes.

    (currently IRS form 8332), or be subject to the contempt powers of this Court upon their

    failure to do so.

    I think him taking her to court and having a Judge mandate that she sign the 8332 listing all the

    applicable years is a good idea.

  9. There has been discussion that the IRS does not care about any divorce decree, stating "mom" can

    claim child every even year and "dad" can claim child every odd year, and so on.

    This divorce decree states:

    The Plaintiff, (client name), shall have the right to claim the minor child for tax purposes.

    The parties agree to cooperate with the opposite party and sign any forms which are necessary

    (currently IRS form 8332), or be subject to the contempt powers of this Court upon their

    failure to do so.

    Mom will not cooperate and refuses to sign the 8332. Client wants to go forward and claim the child

    and attach the divorce decree. Mom has already filed and claimed the child.

    Not sure if this is going to fly or not. I think the only thing he can do is take her back to

    court about her refusal to sign the 8332.

    Any thoughts?

  10. Have a client - single, no children. He received unemployment in the amount of $2312.00.

    None of this would be taxable so line 19 is zero. He did have federal tax withheld in the amount

    of $172.00. He has some interest from a savings account in the amount of $89.00.

    When clicking the "check return" button, I get a red error stating:

    Error: Irs Exclusion: Tax withheld must be less than the sum of wages, taxable interest, ordinary

    dividends, ....etc" You get the idea.

    Can this guy not e-file because his adjusted gross income is $89.00 but his federal tax withheld

    was $172.00, which is more than the sum of wages, taxable interest, etc?

    Never had this before.

  11. Clients had their home broken into with many items taken. Police report was filed and insurance

    paid out some. I have all info related to this.

    My question: Form 4684 states: "Use a separate column for lines 1 through 9 to show each item lost or damaged from a single casualty or theft".

    In this case, there are 31 items. Most were jewerly. Do I have to list each ring, necklace, etc.

    separately? Or can I lump sum the jewerly?

  12. Client called to let me know they purchased a new vehicle (forgot to tell me that 2 weeks ago). I questioned if it was a new vehicle, etc. She said yes. She faxed me the statement of the vehicle sale and this is a 2006 Dodge with 5750 miles on it. In the area where it states how the vehicle was sold as (new, used, demo), new is x'd. That seems like a lot of miles for a new vehicle but not many for an '06.

    The instructions state that "the original use of the vehicle must begin with you".

    Any thoughts?

    Hear that a lot. "my friend said blah, blah, blah, my sister got this much..etc." That's

    when I tell them "You can have your friend/sister do your return. It's ok, it won't hurt my

    feelings. Would you like your w-2's back?"

    Why do they never take them back?

  14. I downsized and purchased the 1040 Program and paid the extra $200 for unlimited e-filing.

    The 1040 is supposed to be unlimited prepartion of all federal 1040 forms. I was getting ready to

    prepare return number 201 and a box popped up telling me that I had to purchase more returns.

    Anyone have this problem? I'm on hold with support right now, but you know how that goes.

  15. I know it's not a great option, but you should be able to get satellite internet through a company like HugesNet. They claim to be available everywhere (in the US). The big downside is the price. I believe it is at least $70 or $80 per month.

    Yeah, I've checked into that. (it is around $80 a month)I was going to do that until I talked

    to other people who have it. They say during the day it's not that bad, but after 5:00, it's about

    the same as having dial up. I have a full time job and prepare and efile returns after 5:00 so I

    didn't want to spend the money if I wouldn't get the benefit. I'm just going to deal with it this

    last tax season. I've been preparing taxes since my son was 6 months old and I've been saying that

    I was done when he graduated. Well, that is this year. Not sure if I'm going to miss it or not. :)

  16. OK - in the wake of the SBBT debacle, I contacted CCH Customer(non)support and asked if I could move to Fee Collect. They said it was no problem, just sign up from the website. Nothing to do to unenroll from SBBT. So I did the enrollment in Fee Collect on line on Monday. Tuesday we get the enrollment e-mail. Try to add fee collect to a return. Red Errors. Call customer (non) support and they say it was taken care of in an update but they don't know why it did not work for us. Should be fixed any time. It is now Saturday. Three returns are being held up for fee collect. Can't use SBBT either. On the phone for hours. They lost our incident number. Gave us a new incident number. On the phone for hours. They promise to send an e-mail by the end of the day. No e-mails. On the phone for hours.

    On hold right now for customer (non) support.

    This is the 5th day with this problem.

    they can't tell me who does know

    They can't escalate to a manager

    I hate CCH....I hate bank products....I hate Customer (non) Support hold music.

    I could have written that Tom. I emailed support, was on hold for hours on end, etc. When I emailed them, I received an email back that they would respond within 24-48 hours. I was not happy. I responded to that email with "support is a joke, knowledge base is a joke, waiting 24-48 hours for a response during tax season is a joke, and on and on..." You get it. Within a couple of hours, I received a response that I need to be patient. Now, I could get a response that quickly to tell me to be patient, but I would have to wait up to 2 days to get a response to my problem! I hate waiting on hold for that long. I hate the music too.

  17. On the rejected returns, were they people who get SS? And if so, did you show the $250 they got on the Sch M? Although the SSA form does not show the $250, the IRS does have the amount that was paid out by them, and if you do not enter it, the IRS will reject the return because it's claiming too much credit on the return.

    Well, strangly, I efiled 10 returns that night and the ONE return that I did

    show the $250 (only filer who received it) is the only return that actually went

    through. They are going through now ok. It's an update problem in my program. I

    can choose automatic and it says everything is updated, but it actually isn't.

    Support told me it's a "dial-up" thing. (will tell you it's updated when it really isn't) I update everything from the web now and seems to be working. I was getting

    frustrated as I had never had this problem before. And I was confused because of the

    one return that was accepted. (before I updated and resent everything back through)

    All is well now. (I know, I shouldn't say that) Having a drink and relaxing now. No more

    returns for me tonight.

  18. Thanks KC. I tried that too. When I click on Manual, I wait, then a box pops up that says everything

    is up to date and there are no new forms available. Oh well.... always worked before. I give up. :dunno:

    The good news is that returns are going through now without a problem. Yeahh..

  19. This is what I do.

    I select manual and then it tells me everything that it is available. I glance at my 3 states and 1040 (for curiosity). Then I hightlight them all and click on download. I have always done it this way and works for me.

    I have always done that also. Won't work this year. My returns were rejected again this a.m. After

    being on hold forever and finally talking to someone for about an hour, I was told that if you have

    dial-up (I don't have a choice where I live...nothing is available) then even though the program says

    it has updated, most of the time it isnt. A problem this year is what I'm told. Updated again from the web. Created and resent the returns again. Not getting my hopes up. Just getting more frustrated.
