  1. The executor is a family attorney, out of state. I have talked with him but he knows law, not tax law. I have 2848s on file with IRS, one for tp and one for spouse, but I believe the one with him expired upon his death, correct?

    Thanks for your responses. The refund check is more than spouse's annual income so it's important that I not flub anything up. I don't feel comfortable relying on my muddled, fried brain alone at this point.

  2. I hope my crazy topic title caught your attention. Single taxpayer filed 2008 tax returns on 10/17/2012, and died 11/10/12. He (his estate) received federal and state refund checks 12/2012. Large refunds; $16350 from IRS and $6575 from state. He married in 2009, so spouse has possession of uncashed checks made out in husband's name and is trying to get current with taxes. IRS has instructed to write "void" on the check, enclose it with tax return and a note to have the refund amount applied to 2009 taxes which are $12675. Normally that is what I would do but do any of these other extenuating circumstances - death of taxpayer whose name is on the check and who filed single before but is married in 2009 - change how you would handle this? If voiding etc is the way to go, should I have spouse deliver paperwork and check to the local (90 minutes away) office?

    Interesting note; deceased taxpayer was an investment advisor who did tax returns for others but just procrastinated when it came to getting his own filed. And of course he handled all financial matters so wife, who has been a waitress at Marriott for many years, knows nothing about taxes other than filing with her one w2.

  3. I charge $25 for one 1099 and the accompanying 1096, and $10 for each additional 1099. That's what I billed back when I did them by paper, when a 1096 and 1099s had to be mailed in. Now I do it much more quickly and easily by e-filing (no additional 1096 to prepare) and I just continued with the old rate.

  4. For me, it was one of my most complex returns. One night I left the return open overnight to see if the "processing" would ever complete, but it was stil in the processing state in the morning. Finally just had to bite the bullet and start from scratch and so far it's fine.

  5. With the federal penalties per shareholder per month for late filing of forms 1120S, I feel better e-filing and getting that acknowledgement. I've had IRS claim they didn't receive paper filed 1120S's that I know were mailed. I'd rather e-file than mail certified.

    Colorado doesn't accept e-filing of corps or partnerships yet, so they have to be mailed, but they also don't incur penalties for late filing, so I don't mind the risk of mailing those.

  6. Thanks for the suggestions. I have not moved the clients that disappeared and yes I have multiple backups. Here is the amazing thing, the client names show under the client management tab. I know it seems wierd and I promise I am not crazy, but by the time this is solved I might be, the clients have disappeared from the client profile as well as every backup that I have including back blaze that we checked and figured that was a sure fired way to retreive them. However, nothing !!! and now it is call the one client to see if she would be so kind to let me see her return so I can recreate it. If there is anything comforting about this is these returns do contain the Sch A which I did not transmit yet so the client is not expecting their refund for a while. No one in support can figure this out and they have seriously tried.

    Terry, did you ever find a resolution to this problem? The very same thing happened to me just now, and I remembered you relating your experience which seems similar to mine. My client has disappeared from everywhere except the Client Management window. It even shows the correct refund in the CM list. But I can't access the return. This happened after the software froze up. I'll try support in the morning, but I thought you - or someone else - might have a suggestion.

  7. I need to e-file a form 7004 for an S Corp that couldn't get here to sign docs for their 1120S today. I feel like an idiot but I just can't figure out how to transmit the e-file. I open the 7004 form and select the File Extension Electronically box but I just don't see a button or option for submitting the e-file. Help please!

Funny, when I read the end of the question, "will this work?", and you responded "not at home," I thought you were making a joke that getting a divorce and co-mingling joint funds would not work in their living situation "at home." Now I realize that you were making reference to not being near your reference materials. It made me chuckle anyway. I'll take any levity at this point, even if it's just a figment of my imagination.
