I thought that he with the higher income would be the only one that could claim EIC. She said that if I would only read the tiebreaker rules that I would see that they can choose who gets the EIC. RoyDaleOne Posted March 13, 2008 Report Share Posted March 13, 2008 Sometimes a child is a qualifying child of more than one person for EIC. The two people can agree to who will claim the credit.
