    No. You should decide which of the two parents is your client and be extremely careful not to violate confidentiality and professional conflict of interest standards. Then you should use normal interview techniques, including review of any available records, to see if your client meets the requirements to claim a qualifying child. Tell your client what you are doing and discuss the possibility that the other parent's preparer might see things differently. Then prepare the return accordingly.

    OK, he has been my client for several years and now she is coming to me as well. Perhaps the best thing to do is have one or the other of them sign the 8332 each year so they can alternate who gets to take the child each year.

  2. Man and woman have a child and they were never married. There is not a custody order of any kind. They split the visitation 50/50 and each pay for 1/2 of the child care expenses. Child is covered by both of their health insurance plans. Father lives with parents so he can't take the EIC and Mom earns more $ than Dad. Should I file him as S with Dependent and 1/2 of child care and file her as HH, nondependent, EIC, & other 1/2 of child care?

  3. You can take a deduction IF it was documented correctly, but in the year of donation, not now. does he have a qualified appraisal? Did he transfer the property? The fact that it was still on his land is irrelevant, as long as title to the building transferred. Does he have a receipt? I did get one of these through audit, but it has to be done correctly. The fire department has to have complete control over it; no retrictions on how long or what they do to it (sometimes they won't burn it, but just punch a lot of holes etc). These donations have failed in TC cases where for example, the donor was going to have the lot cleared anyways and stipulated it had to be burned within 4 months, etc.

  4. I have a client who donated an old house on his property to the local fire department for practise. They used it for 2 years and then he had the lot cleaned up and it is now just part of his homestead. He had the house appraised and documented for a value of $12, 000. Does this qualify as a charitable contribution and is the local fire department a qualified non for profit?

  5. I have been with ATX for 8 years and this year I can't seem to find out when some of the features are up and running.

    Last week I spent almost an hour, with Tech help on the line, trying to figure out how to print my practice check to fax to River City Bank; only to find out that this was not available yet; news to me and tech support. My question is how is everybody finding out about this new stuff? I go onto ATX website daily and find nothing posted about what is ready to go, etc. I even called River City to find out that everything is going through ATX this year and they couldn't answer questions.

    Hope this is making sense,but it seems that since they shut down their forum last year I am having a hard time finding out what is going on. Thank goodness for this forum, it only took me 3 months to find you!

    Please help!
