  1. Does anyone have any idea as to when ATX might have an update for Vista? I have emailed them several times and all I get is the Ole "Copy & Paste" answer to go to the knowlegebase about Vista. Of course I did that before I bought this new computer. It says it will be available the end of April. I am still waiting.

    I would really like to use this fancy new machine to do taxes on and retire the old OLD one!! :blink:

    And I do really like this forum. I miss the old ATX Community so much. I didn't post much but I really learned a lot and had a LOT of laughs!

    Look for the search feature below and put in a search parameter of "Vista" without the quotes. You should get at least three threads...this one included. Vista seems to work for some but may be not for others.

  2. I don't believe that public disclosure of dollar amounts of fees are an accepted business practice.

    I really suggest the Webmaster check this out before anyone answers. It might be against the Federal Trade Commission policy or other such regulatory policy. It MIGHT be construed as price fixing.

    Your concerns may be valid, however this site is not affiliated with any particular organization or any specific profession. That said, we realize that many members are in the tax prep profession, however, that is not a requisite to becoming a member here. An unorganized group of people discussing any subject doesn't seem to be grounds to suspect a conspiracy to set and control prices.

    Moreover, while I'm sure the "webmaster" can speak for himself, I wonder if it is within his time management constraints to do the research you suggest. If you have strong feelings about the FTC, and the possible illegality of what we do here, perhaps you could do the research and let us know.

  3. Actually the other condition was mentioned in the original thread. The original post said the child was placed with the taxpayer on 8/9/2006 which means the residency test was not met and therefore no EITC.

    Well, there are certainly other conditions that have to be met. The thread was started by asking about the ATIN so the other conditions were not mentioned. We know nothing about the child's age, and while an adopted child is treated (for tax purposes) as the taxpayer's biological child, apparently the adoption had not been completed before the return was filed. If true, the child fails the relationship test as well. So, yes there are other conditions that must be met in order to claim the child as a qualifying child for EITC. The parents. however, may be able to get some EIC based on NO CHILDREN, or on their own biological child, if they meet the conditions of that scenario.

    The only point here is that this child is NOT a qualifying child for EITC because of the ATIN and no SS#. The rest of the conditions are moot. If you fail one condition, you have failed....

    Not a chance. Without a doubt, the people who know about and refer callers to this site are not doing so in an official manner. If they had the blessing of CCH, I'm thinking the original site wouldn't have been car bombed.

  6. I'm not sure that is true. The publication on EIC (Pub 596) gives an example where the parents do not have valid SSNs, and so do not qualify for EIC. They apply for valid SSNs, but do not receive them on a timely basis to file. When they do finally get the SSNs, the publication says to file an amended return to get the EIC.

    In the case cited here in this thread, the child already had an ATIN. In the case you're citing there was no original Taxpayer Identification Number for the PARENTS. I'm not convinced that we're talking about the same thing. My point is that if the child was disqualified at the time of the filing of the tax return...that fact cannot be changed by later filing an amended return because the situation changed AFTER the filing of the original, in other words the original facts remain unchanged. Also see:

    Pub 596 Chap 2 Rule 8:

    Social security number. Your qualifying child must have a valid social security

    number (SSN), unless the child was born and died in 2006. You cannot claim

    the EIC on the basis of a qualifying child if:

    1. Your qualifying child’s SSN is missing from your tax return or is incorrect,

    2. Your qualifying child’s social security card says “Not valid for employment” and was

    issued for use in getting a federally funded benefit, or

    3. Instead of an SSN, your qualifying child has:

    a. An individual taxpayer identification number (ITIN), which is issued to a

    noncitizen who cannot get an SSN, or

    b. An adoption taxpayer identification number (ATIN), issued to adopting parents

    who cannot get an SSN for the child being adopted until the adoption is final.

    Remember the ATIN is NOT for the parents ...it is for the Child.

  7. I have a client that adopted a child in 2006. The child was placed with the taxpayer on 8/9/06 and the taxpayer applied for and recieved a ATIN. The adoption was finalized in February of 2007. I filed the tax return and erroneusly used the adopted child as a qualifing child for the EITC. The taxpayer recieved a letter saying that we can't do that. My question is: Since the taxpayer can now get a SS no. for the child, can I go back and amend the 06 return and report the child under the SS No. as a qualifing child for the EITC. Thanks for any help.

    Without any research on my part, my guess is NO! It is what it is at the time it is. So, at the time of the filing there was only an ATIN, that will be the disqualifying element.

    The documents and the law at the time of filing are controlling. Things that occur AFTER the filing, as far as meeting the IRS conditions of a thing, would not be retroactive. I'm sure others will have differing opinions.

    Can you apply for a driver's license (minimum age 16) if you're only 14 but know you will be 16 some day?

    As soon as he mentioned the CPxxxx. One problem is that he's the type of person who, when you're trying to explain something, says...well, I don't care about all that just tell me how to solve the problem.

    I WILL solve this for him, but I do not want him as a steady client, you know the type.

  9. It is interesting that some people, neighbors and friends, who know you are in the tax prep business insist that there is hardly reason that they would hire a tax professional to do their taxes. After all, they have been doing their own taxes for YEARS and know EXACTLY what and how to do it. (It's so simple a caveman could do it attitude) and THEN>>>>the CP2501 comes.

    Well, the neighbor says, all I did was clean out my investment portfolio and forget the $127,000+ in stocks I sold, now they want a either $42,213 in taxes or a Schedule D showing the purchase prices. How could they (the IRS) think the basis in the stocks was zero as they stated? I got that all straightened out, though, but then I got this other letter - a CP2000

    And who do they think they are reducing the amount of my IRA deduction. I'm over 50 and I only deducted $4,500 (2005 return) in fact I'm 69 and so what that my employer has me on their retirement plan. There is no law that says I can't work AND collect social security AND add to my retirement through my emploter....IS THERE?

    Well no, not exactly I said, it's just that your IRA deduction may phase out depending on other factors. Phase out??? What is that?

    And on and on and....

For those who are still confused, reader Alistair Pike points out that they can try reading the actual GST Act, where all will become clear.

Here is a sample from chapter 4, part 4, subdivision 165 of the Act "For the purposes of making a declaration under this Subdivision, the Commissioner may: (a) treat a particular event that actually happened as not having happened; and (B) treat a particular event that did not actually happen as having happened and, if appropriate, treat the event as: (i) having happened at a particular time; and (ii) having involved particular action by a particular entity; and © treat a particular event that actually happened as: (i) having happened at a time different from the time it actually happened; or (ii) having involved particular action by a particular entity (whether or not the event actually involved any action by that entity)."

    Perhaps, on reflection, the GST helpline need only carry a simple repeated message: "No worries, mate, we're making the rules up as we go along."

    Well, some may say you're too pretty... :P I think there is a place to put an "avatar" and another to show a photo. I see your drawing of "Killroy" when I view your profile. Try putting it in as an avatar also...I believe it'll them show up.

  15. I haven't changed anything, but I think I can explain the difference in the numbers.

    I did a quick check, and it looks like the total at the bottom of the front page is the total number of registered members.

    Right now, there are 10 people who have started the registration process, but have not yet validated their e-mail address. These people are not counted in the total because they can't yet log in and post, although you can see their usernames in the list of Members. Members who do not validate their email within 30 days will be deleted automatically by the system.

    And yes, you can trust that Newest Member feature.

  18. That's odd - I just went there and the board came up as usual. There was also still a bunch of spam on it.

    It may be a spoof message from a spammer. The board is still up as of seconds ago and with more than the usual amount of spam.

  19. I don't know how many of you care now, but I have installed Windows Vista Ultimate and all versions of MAX back to 2004 work very well with that operating system. As we all know, there was some question as to whether or not it would work properly. I, so far, have not encountered any problems.

    I am still very upset about the way we were all handled, or better yet mishandled, by CCH/Tax Wise/Kleinrock/ATX. I'm evaluating my options for next tax-filing season as many of you are. It is good to see many of you on this forum.

    Wayne, I'm sure many of us still care about the ATX program operation. Yours is good news to those of us who may be purchasing a new computer in the coming months that may be loaded with Vista. Dell, however, has gone back to giving the purchaser an option as to XP or Vista, that seems to be a good move.

    In any case thanks for the information. It gives one the confidence needed to load an archived ATX program on a machine running Vista.

  20. Naturally if you ask an attorney, he will advise a solution that produces a large attorney fee.

    A statement such as the one above about an attorney's motive is akin to saying that ALL tax preparers are only interested in charging large fees and don't care about their clients, just their fee.

    Obviously, neither statement is true, so without implying, or agreeing with the previous poster that all attorneys are corrupt, there probably is some merit to the suggestion of getting a second opinion.

    Yes, the bankruptcy laws have changed substantially, and complete debt forgiveness is no longer an option, based on what little I know about it.

    The worse thing a person deeply in debt can do is to believe that the situation is hopeless. The next worse thing they can do is to remain quiet and not discuss their situation with the creditors. Most always, the creditors are not happy that the accounts cannot be paid as agreed, but are willing to discuss the situation and to arrange some formal payment plan which may exclude turning the account over to a collection agency.

    Banks, and mortgage companies DO NOT want the property, they want payment. If the previous terms of payment are impossible to meet, many times they, the creditors, will work with the debtor to arrive at a payment schedule that will work for all concerned.

    I would try this approach first.

  21. Although I haven't used it, I believe ATX has a billing invoice built into the program. If you go to Knowledge base above and type in billing invoice you might find what you need.

    Yes, the ATX program does have a billing invoice, and a relatively good one loaded with options. I assumed, perhaps wrongly, that Sherri was looking for something in addition to that invoice. And, yes, I know what happens when you assume.

  22. I didn't take 'offense' but I thought you were implying Glynn and William were the brothers who built the company. William has ALWAYS been there for the customers since he started in technical support (although he has worn many hats, just like most of the early people). I can remember this one incident of him carrying around a piece of paper with a customer who had a problem that no one could solve. He carried it around asking everyone for their take on the call until eventually we tried enough things that we finally found the answer (If I remember correctly it was a conflict with a 'windows based printer' corrupting the return data during printing so it showed correctly UNTIL we printed). He does his best to champion the customer's problems to the very end.

    I left ATX in 1999 when my pregnant wife decided that she couldn't handle the 40 degree below zero weather. She was from Honolulu, hence our move to warmer territory. If you owned the program before 1999, I talked to a majority of the users who called technical support. Not saying I took the majority of the calls, just that I got to talk to most of the people who WERE calling the support lines at one point or another. Many of the customers I could recognise by their voice on the phone. But, if you came on board after 1998, I probably wasn't talking on the phone much, just when things got really busy or when the problem couldn't be solved by the normal tech guys.

    I first bought ATX in 1998. I don't remember ever calling support, but if I did, we no doubt talked, although I'm sorry to say that I don't remember. Not remembering as much as you'd like is included in the price for getting older. It is a small price to pay, however, when you consider the alternative to getting older.

    As for William, I never confused him as a company founder or one of the brothers. I did know, however, that he was a very early employee. At one point he talked about his first desk being a door placed flat on milk crates.

  23. Once again, I'd like to express my thank you to ATX for being able to use this board and I hope that I can be of assistance to other practitioners in the process.

    You're welcome here as are all tax practitioners. One small correction though, please be assured that ATX has NOTHING to do with this board, with the exception that many of us are (or were) ATX users.

    ATX, when it was still ATX, and not corrupted by its present ownership, had an extremely useful board with 1000's of archived articles. That board was removed by the new owners and is no longer available, including the archives.

    erc began this board...on his own...with no ulterior motive other than to give the "old" ATXers a place to come and with the hope that this board will ultimately become as useful as the old ATX board.

    erc has no affiliation with ATX or any other software vendor (of which we are aware) and, as unusual as it may sound in 2007, he did it for the good of the users. Outstanding attitude, isn't it?
