Each also get to claim one every year. My question, is the custodial parent still eligible for the Earned Income Credit for the child she is NOT claiming this year? lbbwest Posted February 2, 2008 Report Share Posted February 2, 2008 Earned income credit DOES NOT go with dependancy exemption (neccessarily) take a quick look at this year's criteria to make sure your client qualifies, last year the child was input separately for earned income credit in ATX when not a dependant. I found the answeron the irs.gov page unter practioners - -she does qualify for the EIC even without taking the dependency - -all other tests are met.
