kcjenkins
Has this been reported and has the swindler been charged? Any chance of even partial recovery? I'm assuming you've already looked at Pub 547? You might consider using the optional safe harbor provided in Rev. Proc. 2009-20.
michaelmars
It was only 4k and proc 2009-20 doesn't apply [after maddoff our firm is an expert on this] turns out his agi is just over the limit anyway to get a benefit. but I was curious if the theft of cash is personal or business property. Hate when people like this get scammed, he sent the 4k to a company that promised to get his mortgage modified and the company disappeared. kcjenkins
Well, I'd say theft of cash is personal or business property depending on whether it was business cash or personal. If it was a mortgage on business property, then it would be business, if it was on his home, it would be personal.
