  1. Have you checked the C drive under ProgramDataCCH etc? If folder is not shown, maybe it is under hidden files. I had this going on, needed to check 'show hidden files'. Can't remember off the top of my head right now how I got there to do that.

    The folder only populated when I checked each return and manually backed them up.

  2. Yes, but I don't think we should respond with professional malpractice ourselves. We are only allowed to use client information for tax prep, and that does not include ratting out the competition. Even more, I think it would be unethical on a personal level. Except for hearsay, we do not know and can not know how the return was prepared. The lady has an interesting story, but who can say why she is telling it? Even if it's true, being dishonest is not the same as being stupid so I wouldn't be surprised if the preparer can back up his work with an unaudited organizer or worksheets he claims were provided by the client.

    My money is on stupid and dishonest.

  3. What is on the bottom of page 2 of the 1040. I am dying to know if they put the firm name and PTIN number on the return?

    I don't want to know the name, just if the preparer actually filled out the information.

    It had the preparers name, ptin, and address on the preparer section. Along with their bank account information for the direct deposit. I had no idea you could or would want to get a refund that way.

I completed a return a few days ago and it has completely disappeared from the database and I have only a handful of returns that were backed up this one being one of them but well before the day the return was prepared. If I exit a return and click save where is it saving if its not creating a backup?

  5. Totally agree!

    You are under no responsibility to force them to turn themselves or their prior preparer in. You are also not required to FORCE them into amending the prior return, although you should of course recommend it. You should advise them of their rights and responsibilities. Advise them of the risks of audit etc and if you take on the engagement to prepare the 2013, do it correctly to the best of your ability.

    Further you should not turn your client in to IRS.For licensed professionals turning your client in when you have a confidential relationship with them is malpractice!

    You of course can refuse the engagement if you don't trust the client, but it sounds like they need competent and professional advice.

    I would never turn the client in I would just stop doing work for them.

  6. Please let us know what your client is going to do about 2012 amend or keep the refund? And if you feel the prior tax preparer needs to be reported, let her do it, like most of us you have hundreds of important things to do and don't have time for that, let her get the brownie points or be the hero. Even better yet, send her back to the prior preparer to correct it.

    Last I heard she was informing her roommate of the issues and what the consequences are if the returns were ever examined. I honestly feel she was innocent to the actions of the preparer she kept asking what was in it for the preparer to prepare false documents. She assumed it was to keep her coming back only thing I can guess is that they might have been paid based on refund. Along with their fee there were 6-8 separate charges ranging from 10-30 dollars for processing the refund in house and issuing her one of their checks.

  7. From the moment she left you and went to another preparer who is famous for getting a big refund for "roommate", she is not that innocent.

    Don't report any one. By the way, did she hire you to prepare her 2012? I guess not, as matter of fact, she didn't even call you or make an appointment for her 2012 taxes. She went to the other preparer. She has hired you to prepare 2013, so my suggestion is that you do the job she has hired you to do. Remember, every year is different and one year has NOTHING to do with the other.

    Don't you hate when people tell you, here is my previous year tax return, everything is the same. I always ask, I am surprise you made exactly the same donations and the same milieage was involved.

    She graduated college in 2012 and went to the other preparer. After the appointment spoke with her parents and they told her if she did not feel comfortable and they suggested she come see me for 2013 return.
