  1. Well I just ran into Chaz at Woody's Market this morning. My understanding is Stinky Paul and Janitor Bob were at the Spot last night after work.

    Rumor has it around town that the dinner rolls make you see things that don't really happen? I think JB ate too much last night anyone agree?

  2. Yeah, I kinda hate everybody right now. Especially the retired attorney who called on 2/24 saying he would have his two S-Corps and three partnerships to me by 2/28. Not seen hide nor hair of him. That kidder.

    I second all the above! My carpal tunnel is killing me at this point! :angry:

  3. On a serious note! It's a great place to eat even has a little notable history via Rob & Chad Lowe's Grandfather owning the restaurant and George Bush II visiting on a campaign stop.

    J.B. We need to consider getting Chaz a new bicycle! He's riding the same one on the video.

    Hey the fountain on courthouse square was even running that day. No clown around though. :dunno:

  4. Went to lunch today here in GREEN ACRES, OHIO! Walk into the SPOT and some guy in a clown suit approaches me?

    "Tell Janitor Bob that Kenny the hippy will be turning the fountain on courthouse square back on this Thursday!"

    He also mentioned Chaz, Crazy Mary and Stinky Paul? Placed a bet that the :poop: smell downtown would go away soon.

    JB.............. who's the guy in the clown suit.............. One of your new clients I take it?

  5. "Client brings Multi-Years of unfiled returns to my office.

    Based on following appears filing status is an issue.

    • Abandoned marriage in 2005, moved from state A to State B
    • Still resides in State B
    • Still legally married to this day to spouse in state A.
    • No divorce or seperation agreement ever put in place.
    • No child involved to claim HOH.
    • Does pay child support.

    I'm leaning toward Single as the Filing Status. MFS could open an unwanted can of worms, not knowing if she itemized or didn't itemize.

    Suggestions anyone?

  6. "Special" trip is to run a 10k in Bend, OR.....what did you think...that I would get married...and lose my HOH filing status?! Not as long as my daughter qualifies as my dependent! As a Tax professional, I know that rarely is it financially beneficial to get married...I'll just keep my "sugar Mollie" for now.

    ;) OK JB I'll side with you on this one. Chaz was certain he had the story correct! Mollie is definently a keeper. ;)

  7. Just a note to confirm what I experienced in the past. Filed client's 2011 return requesting refund be direct deposited. As I suspected, client received a notice that the refund check would be mailed as they cannot direct deposit prior year refunds. She received her check in the mail a few days later.

    Thanks for the info JB, should come in handy very soon.

    Chaz was standing back out on the corner today. Crazy Mary stopped me downtown, appears she's waiting on Kenny to turn on the fountain. Say's she's coming over to your place to get her taxes done soon. :P

  8. One year a newly widowed lady whose husband had always handled the family financial maters came in. I looked up from the material I was reading and to my astonishment there she came lugging a small suitcase. About the time she reached my desk the latch on the suitcase released and my office floor was covered by every type of bill known to human kind. The fact she did not return the next year was a relief.

    Reminds me of the little ole lady in the sticks of Arkansas. Brought stuff in a shoebox taped to napkins. She passed 4 months later. Administrator wanted to see her returns, comes to find out she was a miser. Had 10 or so mobile homes in her own park, that she rented out.

    Learned a good lesson that year, them little ole ladies aren't always so innocent!

  9. My apologies the question was somewhat incomplete.

    Client withdrew from a 401k, not from an IRA as previously discussed by other members. When I'm looking at the code it states "Early withdrawals from a qualified retirement plan, SIMPLE plan, or IRA result in an additional tax."

    Question being, in others piers experience are we noticing 401k retirement not being considered a "qualified retirement plan" for early withdrawals penalties and exceptions?

  10. I'm sitting here working on an amendment regarding the same matter, but a medical expense exception. Found this in RIA Checkpoint. Now I'm looking for guidance as the wording indicates an exception.

    ¶ 4344. Penalty for premature distributions—Form 5329.

    Early withdrawals from a qualified retirement plan, SIMPLE plan, or IRA result in an additional tax (reported on Form 5329 ) equal to 10% of the amounts withdrawn that are includible in gross income. (Code Sec. 72(t)(1), as of 10/31/12) The additional tax applies to all withdrawals unless specifically excepted. Exceptions include distributions (i) made on or after age 591/2 ; (ii) made to a beneficiary or estate on or after death; (iii) attributable to disability; (iv) from a qualified plan after an employee's separation from service in or after the year in which he attains age 55 (this rule does not apply to IRAs); (v) not in excess of the amount allowable as a medical expense deduction for the year, whether or not the distributee itemizes; (vi) that are part of a series of substantially equal periodic (annual or more frequent) payments (made after separation from service if from a qualified plan) for the life (or life expectancy) of the employee or the joint lives (or joint life expectancies) of the employee and his beneficiary; (vii) from an IRA not exceeding amounts paid for medical insurance by IRA owners who have received unemployment compensation for at least 12 weeks (or could have except for being self-employed); (viii) from an IRA for qualified higher education expenses; (ix) from an IRA for qualified “first-home” purchases, subject to $10,000 lifetime cap; (x) from a qualified plan to an alternate payee under a qualified domestic relations order (QDRO ¶ 4320; this rule does not apply to IRAs); (xi) made on account of an IRS tax levy, and (xii) from a phased or composite retirement annuity under the Federal Phased Retirement Program. (Code Sec. 72(t)(2), as of 10/31/12, Code Sec. 72(t)(3), as of 10/31/12) FTC ¶ H-11100 et seq.; USTR ¶ 724.22; Tax Desk ¶ 145,501

  11. This is some very good advise and approaches to the calls, I honestly thank everyone.

    I'm rebuilding my practice since my son's medical condition has improved. After thinking it through over and over I do need to work on my phone presentation.

    Appreciate the different approaches everyone has shared.

    To Jack: I see some retreads on the way as well. "My sister did them for me." (After a HOH audit) :wacko:
