  1. Parents have son who is 20 who is their dependent. He has obviously been in college (or took out student loans) but is not a student in 2011. He had income of only $475, plus a grant of $500. He (or somebody else, probably parents) paid student loan interest of $975. I understand the grant will be taxable to the son, which won't make any difference, but because the son is a dependent, can the parents deduct the loan interest paid. Thanks for any ideas...I have some for the son, but that's just my opinion.

  2. I have been e-filing since it began...seems like a lifetime ago...but I have never run into this before and want to make sure I do this right before I file the return. I do know the client (in a small town you know most people's business), she doesn't have a bank account, lives with her boyfriend but does not use his address for her personal mail, she does have a PO Box. Will the IRS mail a refund check to a PO Box? Or am I just making things more difficult than they are?

  3. I don't know about the other dates, but the chart's date for mail is the date the check is to be mailed and all the dates , dd & check by mail, are projected dates. The chart states: This is the projected date that the refund will be direct deposited or mailed. It may take up to 5 additional days for it to post to your account or be delivered. The message on the chart in prior years stated "THE IRS DOES NOT GUARANTEE ANY SPECIFIC DATES".

    Are you running version 34? Just got an update that stated "E-File functionality revised to prevent state rejection X00000-005." Still not able to use for paper filing but it seems to go through in E-F. And it is reported with E-Filed Forms.

  5. Client has income of 17,000, MFJ. Oldest daughter is 19, graduated from high school in May. She has a job and earned $6100. Family has 12 year old son. Am I correct in thinking that the daughter is not considered a dependent because she is 19 and earned more than 1/2 her support. TIA

  6. Not the 2010 edition. However, my renewal for 2011 comes with unlimited efiling.

    Looks like I'll have to go back to 1040 Office. Sure hated having to purchase Max to get the unlimited e-file. I didn't install at least half of the program because I didn't need it. It was definitely a waste of resources.

  7. Client's child is in college, most of the money for tuition comes from an accident settlement. Parents could claim her as a dependent except for the fact that they "qualify" for the AMT and the dependencies for the 3 children don't make any difference in the refund or deductions. Since her parents "could", except for the AMT, does that disqualify her from claiming her own exemption amount? Confused yet?

  8. Two clients have invested in IRAs that are held in partnerships. (Gas Resource Partners, LP. They received k-1s for the partnership in the name of the client's IRA as the partner. Do I have to report the information in the K-1 on the personal return, as the K-1 is for the IRA? Now that I have you as confused as I am, thanks for any help.

  9. I guess we all have odd situations come up in our practice, this one tops it for me. Client has son who is in college, and has been for much longer than 4 years and has not graduated. He did not work at all in 2010, as he hasn't in quite a few years. He received a 1098T with box 2 amount of $27,357. Mother paid it, as she has in the past years, the catch is, her "little boy" is 47 years old and has never had a "real" job. I realize he is a "qualifying relative", does she get the AOC credit or does he get the $1000 refundable part of the credit by filing?

  10. HH overrides the itemized deductions requirement, in fact, there is no overriding since there is no such a requirement for HH by definition.

  11. Married clients with 2 children have not lived together for over 6 months (closer to a year). Husband still lives in home they own together, makes all mortgage payments and taxes and is planning on filing MFS and itemizing. She will file as HOH because the children are living with her. Does she have to itemize because he will and they are still legally married, or does HOH over ride that necessity for MFS?

  12. After 27 years doing taxes, this was a first and hopefully a last and never again. Last year a long time elderly client (82) complained that I raised my price on his return every year, I showed him proof that I had not raised his cost in at least 3 or 4 years, this year I did raise it a whole $5, very simple return, and I told him that before I even took his information. Called him when I was ready to e-file, he came and signed the 8879, told him I'd call when I got the ack so he could pick up his return and pay me. (I did trust him) Two days later I called and left a message on his phone, but he didn't come out to get it, a day later his obituary was in the paper. He'd been found dead in his home. Guess he wasn't going to pay that extra $5 even if he had to die to do it.

  13. The young couple whose return I did this afternoon. Last year they had one income, one child, education credit because wife was still in school, plus an EIC. In 2010 they are both employed, earned over 80k and want to know why they don't get an EIC.

  14. Annie in 2008 it was IT-140 plus Sch A. Sch A separated WV income.

    WV changed a few things last year so you might confirm these forms still hold true. Edit: It does!

    Annie (I know I'm going to be seeing a lot more of these in this area. The gas companies are going crazy around here, trying to get people to lease them their land because of the Marcellus Shale boom.)

  15. I prepared a return for a long-time client today...e-filing for the first time. Both collect SS, husband is one of my GM retirees. The return kept being rejected because of the spouse's SS# and name not matching. SIXTY YEARS ago the wife didn't change her last name when they got married and it was never caught until today!

  16. Client, resident of OH, owns property in WV, which he has leased for gas production (fracking). It is on a 1099 as rents. This is a one-time payment, yearly he will be getting payments as royalties. What forms do I use to report this in West Virginia? I found the NR form but it is for wages only. How do I go about this?
