I just got off the phone with TRX - the $299 (plus S&H) includes all 1040 forms, all states with a tax, free unlimited e-filing for both. Also includes the business (including corps, s-corps, partnerships, trusts) forms - but no e-filing. The $699 package includes unlimited e-filing regardless of entity type.

Anyone having a problem with the state return not printing in the "filing" copy even though it clearly shows up on the "print tax return" screen? Any suggestions?

Code 05 on form 5329 is for the medical exception. My question would be is this sufficent action or should TP have the issuer of the 1099 R correct the Distribution Code.
You have outlined the correct procedure - tax preparer completes form 5329 - uses code 05 - no penalty. Issuer of 1099R has used the correct distribution code assuming your client is under 59 1/2.

I would agree with Jainen, with no recapture if taxpayer stays in home for at least 36 months - CCH cite is same as taxbilly's .

PA Department of Revenue has a legal letter ruling No. SUT-04-004 (google it just like it's shown) - this may have the answer you are looking for.

I agree with Jainen - if the SUV, otherwise qualifies i.e. business %, etc., it doesn't make any difference if it's new or used.

I agree with Jainen and JohnH. The client, or someone else, may have have thought that SSI was qualifying income and filed the return.
