real estate taxes deduction

Recommended Posts

I have a client who is being disallowed the real estate taxes deduction he claimed on Schedule A. IRS claiming taxpayer doesn't have a valid SS#,,, which is correct.

I have been looking on all IRS publications to see If I can find anything related to what the IRS letter claims. Yes taxpayers don't have ss#, they do have ITIN#. they have a property and pay real estate taxes.

Anybody knows where to find more info.. ?

Your help is appreciated

Thank you

Hugo

Why exactly are you using an ITIN? Your client can not file with an ITIN if he is eligible to get a Social Security number, right?. So using an ITIN must mean he is a non-resident alien. And like the IRS has told you correctly, non-resident aliens are NOT allowed to deduct real estate tax on Schedule A. Check it out in Pub 519.
