TRUCK DRIVER MEALS

Have TP who arrives at terminal. If truck is loaded he leaves to deliver trailer at next terminal(5hrs drive time). Drops trailer and waits for another loaded trailer to return to home terminal. Wait period may be 30 minutes up to 2 hrs. Return trip is 5 hrs drive time. Can TP have a meal deduction under transportation rules? TP not allowed to work more than 14hrs in day.

Not always true Gene. DOT rules say if the driver is required to rest, it counts. That is any day with 11 hrs driving. So if he has 11 hours on his log book for the day, it counts for him. Maximum driving time is 11 hours. After 11 hours behind the wheel, the driver must have 10 hours of rest.

Maximum on-duty time is 14 hours. After 14 hours on duty (which may or may not include up to 11 hours of driving) the driver cannot operate a commercial vehicle until he has had 10 hours of rest. The 14-hour on duty time begins when a driver comes on duty and can only be stopped with a minimum two-hour break in the sleeper.

KC has given you the details - the "long story." The short story - No deduction in the situation you describe.

You ask, "Why?" Because in your situation there is no "requirement" for rest (in order to be able to complete the trip.). Driver is not sitting at the turn-around terminal because he is "required to rest," he is sitting there because the load isn't ready.

An added perspective, if the "wait time" gets excessive, i.e., by definition of union or company rules, then union or company, or both would have provision for Driver to check into a motel for legal "time off" before returning. Correct?

One other consideration, is the "wait time" on-duty (line 4 on the log) or off-duty (line 1 on the log)?

Well.......I guess my "short story" turned out to be longer........ O Well! this is life!
