Another dependent, edu credit

Client's child is in college, most of the money for tuition comes from an accident settlement. Parents could claim her as a dependent except for the fact that they "qualify" for the AMT and the dependencies for the 3 children don't make any difference in the refund or deductions. Since her parents "could", except for the AMT, does that disqualify her from claiming her own exemption amount? Confused yet?

Today is not a good day.

The student can not claim her own exemption in this situation. However, if the parents do not (that is, nobody claims the exemption) the student CAN claim either the AOC or LLC as otherwise eligible. This rule is the same for both credits. The student can not get the refundable credit on her own return if she is under age 24.
