  1. This client is my pain in the ____. I have been calling him for weeks and now he calls me and says he has 2 1099misc to file.

I knew that in January. Is it to late to file and can they still be efiled? I know the are due in february.

Second question. I filed 1099 misc for a client several years ago an do not remember filling anything out for the state. Now on the efile form I see a question about filing form 6847. Is this form necessary or not.

  2. You haven't told us where the S Corp normal operation is. Is it at the same home or somewhere else?

If the S Corp's operation is at another location, and the S Corp does not reimburse for the expenses of the home office and it actually does qualify as a home office, then why couldn't the home office be taken as 2106 expenses on clients SCH A?

  3. I hate to admit it but I am the worst speller, good with numbers but can’t spell a good groceries list.

I down loaded the iespell yesterday on to my desktop and ran the setup but it still is not working when I post. Can anyone tell me how to make it work?

    Thanks Linda

  4. Client completed return 02/10/10 but she wanted me to hold off on filing the return until she made her contribution to her HSA it had to be reopened (she closed it because she was laid off, but still kept the insurance thru COBRA).

She has just gotten back to me and said to go ahead and file the return. It has been a month since the 8879 was signed, do I need to get her back in and resign with new date.

  5. Do a search for the history both here in Chat and in E-file. The solution: either uncheck the box or keep the check and type in your name, telephone, and PIN. IRS has gotten serious about us not using the generic Preparer.

What five digit pen are they talking about. my ptin is 9 digits counting the P.

  6. This is the only return doing this, But with new client the third party designee if checke yes will not let me creat the Efile. It claimes there is an error missing preparers 5 digit pen and preparers phone number. Everything is listed on the paid preparer's line as usual. Has anyone else had this problem TODAY? Yesterday it worked just fine.

  7. Client gave me a list of Energy efficient upgrades to her house for the credit. After thinking on it for a few minutes I recalled that she spent 2 years redoing her home (back to bones and then refinished). I called her and asked if all the expenditures were were acutually completed in 2009 and she admitted some of them were 2008 expenses (paid for and installed in 2008). Can I amend her 2008 return for the credit or does the credit have to be claimed on the original return. I do not think 2008 expenses belong on the 2009 return.

Also same client received a 1099MISC for a whopping $8. No other misc income (she is an or nurse) I checked the box to include in wages.

  8. First thing you need to tell us is what happened to the assets? What sort of assets are we talking about? If he still has them, did he convert them to personal use, is just holding them until the business climate lets him go back into business, or what?

Client still has these assets. bankruptcy didn't want them. Still holding just in case the housing market goes back up and he is called for his services. Otherwise I guess you would just concider them converted to personal. One of the Camers for detecting Mold cost $11,000. He tried to sell it but wouldn't let it go for $3,000. Other problem some of the equipment was 1079 property 7 yr with 3 yrs left ( I warned them against this).

  9. Client in home inspection (water damage, mold, etc) business for home buyers (not builders). No one buying homes hence no one paying for this inspection. Client got a w-2 job and quit working business. Client lost home filed for bankruptcy.

QUESTION what to do with the assets on record. Some were included in bankruptcy some are not.

  10. If one of the spouses files head of house and also files sch A does the other filing MFS still have to file sch A.

I know the answer is yes but just thought I would check, of course my client is not the head of house. They are staying married only so he can keep her on his medical. Poor sucker.

  11. A Trustee that is assuming the fiduciary responsibilities of controlling the properties and filing any documents including the estate and/or fiduciary income tax return. Address on the 1041 will also be this trustee's address.

    Thanks Old Jack

Thats what I thought but wasn't sure.

  12. This is my first trust return. It is real simple just the sale of the home left by grandmother to 10 grandchildren to be sold when their mother died.

Name of estate or trust not a problem but what do I put for the Name and title of fiduciary? Is the the trustee's name?

    Thanks Linda

  13. I would use box 7........is the private party in the business of excavating or something to that effect?

No the client does the excavating the private party just supplied the land but is not in the business for this purpose.

  14. Client digs swimming pools. He paid a private party to dump the dirt on his property. What box do you report this expense, box 3 other income or box 7 nonemployee compensatin.

    The amount was 900 dollars.

  15. Have a new client that came to me from HRBlock. Their 2004 return was filed single (they got married in 2003). Husband had a 2106 that apparently was denied.

H R Block preparer told them to continue to file single because they would loose part of their SS benefits.

Both are over 65. Both are getting their own SS benefits, however the wife is also getting SSI because her SS benefit was too small.

Does any one know if she would stop qualifying for the SSI if they found out they were married?

Also husband is getting paid by SSI to care for Wife on W2.

I told her I could not do any thing to help them unless they were willing to file a legitimate.

She is gong to call SS office and see if the change in their marital status will affect their income, and get back with me.
