  1. Rental income is generally not self-employment income. Section 1402(a)(1) says real estate rental is not SE income unless the rentals are received in the trade or business of a real estate dealer. Reg. 1.1402(a)-4 explains that "real estate dealer" is someone engaged in the business of selling real estate to customers with a view to the gains and profits that may be derived from such sales.
  2. It didn't download for me this morning. The release schedule still says Monday, 2/5.

  4. We have some partnership returns for LLCs organized in North Carolina, but with all property in another state. In ATX apportionment I enter the income and assets in the state where they belong, and zero in the North Carolina column. I get a red error message as follows: If Part 4 Section B Line 9 or Line 10 is populated with a non-zero value [the partner is allocated income or loss], then Part 2 [apportionment] must be present [it is] and Part 4 Line 12 [apportionment factor applied to allocated income] must equal the apportionment factor from Part 2 [it does. It’s zero]. Can anyone tell me if I'm doing something wrong, or if ATX needs to correct its programming to allow zero apportionment in NC?
