I submitted a return with a 1310 with C, Person other than surviving spouse or court-appointed rep..  It went through just fine, refund deposited.  This was in February.

Margaret, I don't understand why mine would not go thorough. This is not the first time that this has happened with any 1310 for me. I am going to look at it again. I have checked and unchecked various boxes. It is a C with no will. Thanks!

Did you find a solution? I have run into the same issue and nothing I've tried has worked.

I just gave up and mailed. There does not seem to be a way around it, at least not with ATX. The IRS rejected it every time for various errors. ATX support was worthless this time. I think that it is definitely a programming error. They just said to mail. It makes me mad, because I am going to go through the same mess for 2020.

  3. A friend asked me about using online software. He has never done payroll, so he is looking for something that will basically do everything. I have only used QuickBooks and Medlin. I don't think that either are great for someone that knows nothing. I will not be helping. I am just asking as a favor. I don't know why he doesn't want to use ADP or Paychex. Maybe it's too expensive.

Thanks if anyone has a quick minute or opinion.

  4. I got a call today from someone that I have not heard from since I prepared his 2019 1120s, called today and wanted to bring in his stuff. I told him that I had not heard from him and had not filed an extension. He has another person doing his bookkeeping and payroll taxes, so I thought that he had gone elsewhere. My engagement letters all say that my services end when the return is complete. He hasn't even paid for last year. I don't know if I can get him out of the late payment penalty by blaming my Covid diagnosis on Monday and brain fog. I honestly don't care, but that's because I am really crabby, sick and sad. I'm just generally not very nice today. I can't smell or taste as of today and I hate it. The only thing that is useful for is changing the cat boxes. I am going to bed early tonight in the hopes that I might rested tomorrow. Today I felt like I had not slept at all. I should be able to sign up for my first vaccine next week. I will make my appointment a couple of weeks out, so that I will hopefuly feel much better.

Thanks for listening to me whine.

  5. Some Good News! My husband went to the Covid Clinic today and he does not have pneumonia. His lungs are clear and the horrible cough is Covid and his COPD combined. We just have to keep watching his oxygen levels. I do not recommend both people in the house having Covid at once. We are both exhausted and spend more time thinking about moving than actually moving. I was so active before this and I hate it. I hope that I get some strength back by the end of the week. I did pull out the vacuum and push it around tonight. I can only stand so much black fur from three cats.

Thanks for all of the support. I am happy about the 5/17 deadline, but I don't know if any of my states will go for it.

  6. Judy, I don't have any help. My husband is my helper. His COPD and heart failure make him high risk, but he has only had to use his rescue inhaler once so far. They will xray him tomorrow and then we will see what they decide to do. At least he is stuck in the house with me and I can keep on eye on him. I am mainly exhausted and week. I keep hoping that I will lose my appetite, but no such luck! I'm still hungry, but can't work out at all.

    Thanks,

heard it from an IRS agent - Tax practitioner this aft about 4:30

yay! I do not have to file all those extensions!!

Hired someone today just for a couple days to do the rest of the 30 PPP loans

but I only got some help as once again the system was down and the CAF's did not work..

could only do 2019 PTIN and designated 3rd party  - but did do that!!

and he was patient as I scrambled to come up with 5 names total

d from glorious NC WI that missed the big snow!

I hope this is true, because as if my year didn't already suck so much, my husband and I have Covid. I was afraid that he was sick last week, but he was positive that he was not and did not get tested. I got sick over the weekend and tested positive yesterday. He got tested today, but we know the answer. His dr is sending him to a Covid clinic tomorrow to get checked over, because he is so high risk. I just need to keep him at home with me. I already lost my mom and I can't lose him, too. I hate this year.

  8. What the heck am I doing wrong or is it another ATX screw up? This is a 2019 return for a client that died in 2020. We were waiting for a personal rep statement. Now the attorney says that there was no need for a court ordered personal rep even though their invoice says that filed for one. My client died without a will and everything was POD. I checked C on the 1310, no to will and yes to distribute. I read the rules for 1310 and it says to keep a copy of the death certificate. It keeps rejecting with this error. I know that I have to paper file with a court appointed rep, but I thought that this could be efiled. I tried to attach a death certificate, but I can't even create the efile
The XML data has failed schema validation. cvc-complex-type.2.4.a. Invalid content was found starting with

Is she just stuck paper filing and waiting forever for the refund or am I  answering the questions incorrectly?

    Thanks!

  9. Rita, I am so sorry to hear about your mother. I will definitely send prayers, because I just finished hospice with my mom and they were wonderful. They told us to also take care of ourselves. It is not easy to do that when you are worried about your loved ones. 🙏❤️

  10. I have only had one return with unemployment so far and she lost her appeal. She now has to pay it back, because the state didn't think that having to leave the dorms and move 40 miles away was a good reason to quit her fast food job. Nobody was hiring here when she came home. I feel for her, because she is just a kid and they should not have given it to her in the first place if that was not a good enough reason. The state gave millions of fraudulent $ to unknown and random people that they will never get back.

    Rant over. 🤬

You don't want to waste the AOC, which is only good for four years.  If your student plans to keep attending school and only went for one semester in 2020, you might want to claim the Lifetime cr and save the AOC for years when she will have double those expenses.  About those book receipts, students today do everything electronically, look at you funny when you ask for records like 1098Ts or bursar account printouts, and buy books online and never think about a paper trail.  I warm all parents of new students to demand that they get/keep book receipts.  They do come in handy at tax time.

I have a phone call into her to check and see how long she plans to go to college. She is not a full time student and I need to find out if she intends to get a 4 year degree. She is working full time and supporting herself, so it could take her awhile to graduate. Normally, the parents can help with receipts, but they aren't even in the picture.

If you have $4K after you deduct the scholarships from payments to the U, you don't need to mention the books and computer (if any).

Credit card payments to the book store is a good record and I accept them. Technically you have two documents to prove that books are needed and students have to pay.  You have the 1098-T that shows the student was enrolled in classes and most classes require books and you have the credit card receipts.

Thanks. Total tuition and books are $1,900 with a $1k scholarship. I tried making the scholarship taxable, but it cost her money. I am keeping the IRS form with her file. She will keep her tuition receipts from now on, since she knows how important they are now.

  13. I am so sorry to ask so many questions, but I want to prepare this tax return correctly for myself and the client. I have a 20 year old that is actually completely on her own and has been for 2 years. She made $28k and paid over half of her own support. I have a 1098T for her school with the payments and her scholarship. She does not have the receipts for her books, but does have her bank statement with the debit card charges to the college bookstore for her books. I want the receipts for due diligence, but I found the 886-H-AOC from the IRS "Supporting Documents to Prove AOC" and it says that copies of cancelled checks, bank statements, credit card statement or receipts provide proof of payment for other qualified expenses such as additional course related fees, books and supplies.

I have a statement for her to sign that everything that she told me is true and I don't want her to miss out on a legit credit, but I don't want either of us to get penalized. I really hate having to audit everything and not trust anyone. Do you think that I should use the books of just the tuition?

  14. I really hope that this is not a problem. My client is building a house and needs her refund. Box 3 is $83113 and box 4 is $3,787. Unless I am crazy, box 4 should be $5,153. Medicare is correct. It's a Defense Finance Civilian W2. I don't know why it's screwed up, but it does not affect her 1040. She moved to another state and maybe they messed up her payroll records then.

I checked for new Care Act changes that would cause this, but I could not see anything.

    Thanks for any advice.

FWIW There was a post on, (I think), the Drake forum that said this can only be done during certain hours - and the earlier the better.  (7 or 8 am EST IIRC)

Also, prayers, and hoping your son is still flying high!

Thank you! He is still a captain for SkyWest and living in Colorado. He should get a promotion next month to check airman. He will be one of the youngest to get this chance. (Sorry, I am a proud mom.)
