    I would also like to Thank Eric for keeping this site up and running. It has been very valuable. I know that There is a cost associated in running a website we don't see, Eric has done a great job running this website. As a gesture of appreciation i have used the donations tag. I don't care about the recognition but just a reminder to myself and others to help out with the cost.

  2. Okay, Jack, you have me worried. We are running on a Server 2003 environment and have not had a problem with 2010 or 2011, But we plan tentatively to replace the server next spring/summer. Are we going to have difficulty restoring our data from those years when we change machines? I guess there is no point in borrowing trouble.

    I just upgraded our 2003 Server to 2008 server and have installed /copied programs from 2007 - 2010 and installed 2011 with our any problems or issues. all of them are working fine.

  3. Taxpayers home is in Stockton, ground zero for the mortgage meltdown. Familiar story, husband loses job, can't pay mortgage, can't sell because underwater, etc. So the client finds a buyer for the home on a short sale and the bank agrees. Client moves out in 11/09 and the sale goes through. Client recieves a 1099C in 2010 for the 187K of forgiven debt. All good so far. No issues.

    But the client also got a 1098 Mortgage interest statement for 2010 where all of the back interest was paid. Over 23K.

    Can this be deducted on Sch. A?

    I would look at 187K forgiven debt. Was that the actual principal or did they also forgive Interest.

  4. He lived in the US for the whole of 2010, and yet was considered a non-resident. I don't see how he could be a resident of Virginia if he is not a resident of the US.

    NJ will consider it as NR (Same as federal)

    Tuesday, Feb 15th - Status Report of efile limitations and ack processing

    We met our maximum capacity of Legacy e-files that the IRS Electronic Tax Administration has established. We were able to send over 225,000 e-files for the 11 AM Drains. We are anticipating that it will take 24 - 48 hours to receive acks from IRS.

    We have not received all acknowledgments for the e-files that we submitted on Monday, February 14th.

    Kansas City - 16,000 Outstanding Acks

    Andover - 25,0000 Outstanging Acks

    The next opportunity for these return to be acknowledged is today's 11 AM Drains. Depending on the volume of returns being processed by the Service Center, processing could potentially roll over to the 6 PM Drain.

    As we receive them, we will process and post to your electronic mailboxes.

  7. I don't think the issue here is what's deductible and where. It's whether this client should be paying sales tax on his purchases of supplies, even if he likes to call them repairs. He is the end user, and most states deem that the responsible party for the sales tax. Otherwise, it never gets paid.

    I've seen vendors trying to dupe the state out of their taxes by giving clients forms to fill out to pretend they're retailers. The only reason I can think of for vendors doing this is to gain a competitive edge because they don't charge sales tax so their total price is lower. Those schemes are bound to go up in flames when the state contacts the client looking for the sales tax they presumably collected when they presumably re-sold the merchandise. I'd warn your client that this may happen to him one day very soon.

    I think if the client is the end user, I agree there is no sales tax but in most states it's called Use Tax (Sales & Use Tax).

  8. Sounds like mal ware.

    You can get (shareware, free online) Malwarebytes' anti-malware at malwarebytes.org and run it. That should catch what's going on.

    McAfee doesn't catch everything.

    I had that happen a while ago and my computer guy told me to download Combofix.com and run it.

    This is a very good malware remover software.

    Assets from a proprietorship that ends are considered as distributed tax-free to the owner with the owner taking the tax basis of the asset. If that asset is then contributed to a corporation owned by the same person in exchange for stock of the new corporation the asset still has the same tax basis in the corporation even if it is recorded by the corporation at FMV.

    The assets were abondoned at the time and client moved to another state.

  10. Off the top of my head, I think both would pass through to the business as taxable (in the form of revenue or offset to rent expense). Bottom line will balance out with less actual revenue received (if there really was business damage) and expenses in the form of moving the business or possibly increased rent. It makes sense to me that all this would roll together to show the actual results of the business income/expense. If there are other facts to consider, let us know.

    Client was set up as a sole proprietor and has moved to a different state. Did not start another business until this year. New Business ins under S Corp.

    Previous accountant has depreciated everything so all of it is Income..?
