Now that the court of appeals ruled them legal are you going to file the old years or wait to see if NY catches them? Some of my clients wanted to stop filing the returns and some wanted to continue with them. Out of about 125 clients the tax effects only 1 so far received a letter for the prior years with interest and penalties. My plan is to prepare the returns without interest or penalties included, and leave it up to the client as to whether or not they file them. Knowing NY....they will catch up and ask for interest and penalties for anything due.
