Dependent, Education credit

I guess we all have odd situations come up in our practice, this one tops it for me. Client has son who is in college, and has been for much longer than 4 years and has not graduated. He did not work at all in 2010, as he hasn't in quite a few years. He received a 1098T with box 2 amount of $27,357. Mother paid it, as she has in the past years, the catch is, her "little boy" is 47 years old and has never had a "real" job. I realize he is a "qualifying relative", does she get the AOC credit or does he get the $1000 refundable part of the credit by filing?
