AnnieR
I guess we all have odd situations come up in our practice, this one tops it for me. Client has son who is in college, and has been for much longer than 4 years and has not graduated. He did not work at all in 2010, as he hasn't in quite a few years. He received a 1098T with box 2 amount of $27,357. Mother paid it, as she has in the past years, the catch is, her "little boy" is 47 years old and has never had a "real" job. I realize he is a "qualifying relative", does she get the AOC credit or does he get the $1000 refundable part of the credit by filing? Thanks AnnieR
Gail in Virginia
If he could be claimed as a dependent on someone else's return, I am not sure he qualifies for the refundable credit.
kcjenkins
He qualifies for the lifetime credit. But no on the refundable credit for him, since he is her Dependant.
AnnieR
This sounds stupid & doesn't make any sense, but does the mother qualify for a credit since he is her dependent? AnnieR
kcjenkins
Yes, that is what I meant, sorry if it was not clear. She can claim the credit for him, since he is her dependent.
