  1. Are you eligible to participate in the IRS e-services program? If you are then I highly recommend a program - TaxScripts -. The 2848 may be inputted via TaxScripts and, voila', within a matter of minutes your POA is on file and you may download whatever tax information you desire.

  2. OK, don't tell my clients; they will swear that this is their situation!

    I can't wait till May and we have to deal with all the (additional) questions. I think I'll rip out the phone. Or, maybe just not answer and have the IRS # on my greeting.

    That is why I DO NOT discuss how much "rebate" clients MAY get. Then they CANNOT say to me:

    "You told me...."

    I refer them to the IRS website. Then any discrepiancies can be addressed by the IRS.

  3. you file the 1040X across the top write Protective Claim in BOLD LETTERS. When the court makes it final ruling the the IRS will process the 1040X. I would of course send certified with return signature. It may take a while for the courts but you have your claim on time.

    How do you show the refund of FICA on the 1040X?

  4. Client has a W-2C from 2004. The amount of SS earnings, Med earnings, and the associated withholdings are all that are changed, and all are lower.

    Attached was a letter with references to CSX vs. United States Case No. 95-858. Bottom line, the court decision said that some severance pay to former employees should NOT have been subject to FICA taxes, so the company issued W-2C showing the change.

    The letter says:

    The Company will not request a refund from the IRS for the FICA taxes withheld...

    Also:

    Independently, you may want to pursue a refund under Treasury Regulations 31.6402(a)-2. This refund must be filed by April 15, 2008.

    The last paragraph has me confused, as this is the first instance of this we have seen.

    We understand that the IRS has not agreed with the US Court of Federal Claims ruling in the CSX case and my not process your refund request. However, you may want to file a protective claim in order to keep your tax year open until this matter had been resolved with the IRS. You should make certain that your claim clearly states it is a "Protective Claim."

    My question... What forms to file to make this "Protective Claim", and what are my client's chances of being reimbursed? Total amounts to approx $600.

    Anyone else dealt with this before?

  5. Several clients want the credit for purchasing energy saving light bulbs. I do not see this as part of the Residential Energy Credit. Am I missing something? TTB nor 1040express answers addresses light bulbs.

    It goes on the line right below the credit for corn burning stoves.

  6. Here is the answer about using the rebate to pay tax owed from 2007:

    Q. I owe some money on my 2007 tax return but the amount I owe is less than my expected stimulus payment. Can I wait to pay the balance due and simply let my stimulus payment cover it?

    A. You should file your 2007 return and pay the entire balance due by April 15. You should not wait for your economic stimulus payment to offset the balance due. If you wait, penalties and interest will accrue between April 15 and the date the balance is paid, even if it is ultimately covered by the stimulus payment, which will not be available before May. [New 2/28/2008]

    Just tell your clients to expect interest and penalties which can be avoided by paying timely. It is amazing to me the lengths people will go to, to avoid paying something they legitimately owe.

  7. Actually, this year it appears you can. I know, I was in shock also. I just did one with part year CO and WI - went through just fine.

    Keep us informed if your client receives a notice. Our e-file went through just fine, but information from line 41 Form 1PNR did not get transmitted. No evidence of a problem till client got the notice.

  8. How about the newly employed TEACHER who called and wanted to know why she got a bigger refund than her boyfriend...I DIDN'T DO HER BOYFRIEND'S RETURN!!! Don't even know anything about her boyfriend! How the heck do I know? After all the software gave a notice that she was over-withheld! Does that count? Okay, I feel all better now!

    I like the ones who call up and say they got a notice and they do not understand it and could I explain it to them. I ask them if I could get get a copy of it and they say they didnt realize I would need a copy to explain it to them.

  9. I just received a notice showing time schedule of checks being sent out for the rebate. It goes by the last two numbers of your S.S. number. First check show July 23. last date Sept 24. I thought they were supposed to start mailing in May!

    Anyone else seen this. It said source: Internal Revenue service. I could not find it on IRS website.

    That is old information from the last fiasco a few years ago. Kinda like the e-mail about Microsoft and AOL teaming up to send thousands of dollars to people who forward worthless e-mails.

  10. Has anyone else experienced this? We (at the firm I work at) had a client receive a Notice of Refund from Wisconsin, and it boils down to information (in the return when the e-file was created) that was not sent with the e-file. I know the process to correct, (just file appeal with documentation), but we have several clients with part-year Wisconsin.

    Did I miss someone posting about this issue?

    My question still stands. Has the IRS system been "ignoring" these types of returns in the past? It would seem that the "system" has not been able to accept "limited-information" returns. I would like to know the definition of "limited-information." What if a taxpayer has enough W-2 income to qualify for the rebate, but not enough to be taxable? Is this a "limited-information" return? The Practitioner Priority Line person could not answer these questions for me with more than "we will just have to wait and see."

  12. The local IRS walk-in service center says that it MUST be paper filed and that you absolutely cannot put in $1 to make it be accepted as an e-file. She said that caused some sort of glitch.

    Did you ask the IRS person what would happen if the person had more than $1 of other income? Would it still not "process?" I am of the mind that the IRS does NOT KNOW what will work or what will not.

    If a retired taxpaying couple had $21,000 in SS earnings, $800 of interest income, and $1,500 of W-2 income, could the 1040A be e-filed? Could we file a 1040 with all the information to get the taxpayers into the system for the stimulus payment? Has the IRS been "ignoring" all the "information returns" where there is no tax liability? I have a notion that when the second letter from the IRS telling who is eligible, and how much they will receive, start arriving in mailboxes, lots of people are going to be disappointed, and I am not going to put myself in the position to be told... "But you said I would qualify."

    Another thought, how would someone at the IRS entering the information from a paper return into their system, be any different from us e-filing the same information?

  13. I came to ATX from Intuit's ProSeries when the prices got too high. I've been very pleased with the ATX product. All the forms it does is impressive. All the payroll taxes, sales taxes, property taxes, etc. The only forms I've not been able to use it for are a few local Food & Beverage Tax forms.

    Obviously, the tech support service has been worse this year than when ATX had their own. But, this is a transition year for CCH. It's their first year with it. And between the message board, and the the ATX website I've been able to resolve the few issues I've had. It's affordable for me, I think it's a very good value. I hope to not have to make a change. There's no guarantee that Drake won't be the next one acquired by some some inept giant, and be having the same issues that ATX has had this year. If all the ATX users switch to Drake, they might be overwhelmed by the increased volume, and have problems from that.

    I hope you realize that neither ATX, nor CCH have anything to do with the running of this board. It is being run by a group of ATX users that decided it was too great a resource to let disappear. ERC is the username of our webmaster, and he has a group of people assisting him. They are doing a wonderful job and deserve our respect and support.

    CCH decided to DELETE the old ATX board just a few days before the end of tax season last year.

Just when you think it can't get any more ridiculous...client called the # on the Variance letter, person she talked to gave the same spiel about PY returns, told client that she would be sent the form in the mail, attach it to the variance letter, etc. Client brought it to me and guess what????c'mon, GUESS!!

    "THEY" SENT HER A 2006 RETURN TO file!!! What the heck is going on???

    The 2007 SD 100X is different than the 2006, and being a State agency, they probably have not seen fit to distribute the new forms till all the old ones are passed out. It will still work, just change 2006 to 2007. The ATX SD 100X is easier to use (I don't believe I just said that).

  15. After more investigation, the issue with part-year and non-resident SD 100 forms IS an ATX problem. If you create an e-file with either of these in the return, you get a blue message that states something to the effect of "...information from line 2 or 16 will not be transmitted with the State of Ohio return."

    Does anyone at ATX care? This is the second year in a row for EXACTLY the SAME issue. (I guess that is a rhetorical question...) I have sent several e-mails (more futility) in an attempt to get them to correct the problem.

    Nonetheless, Part-Year and Non-Resident SD100 forms must be paper filed, and the form must be removed from the return to create and send the e-file. Hopefully this will save some other folks on here some headaches.

    I have a template with the SD100X and accompanying letters set up already, and have used it 3 times. Seems the State of Ohio is johnny on the spot with those variance notices this year.

    The watermark only means that the form is not approved for PAPER filing. E-file will work, since only the data is sent.

    You can do paper by hand, print from the SC website, or E-file. There are always options. To say I CANNOT finalize their returns is a misnomer. Sometimes we have to do "a little extra" for our clients.

    ATX has to wait for approval of their forms from SC, and in years past, my experience with Ohio has been, that sometimes the states do not put approval of software company's forms very high on the priority list.

  18. My wonderful and lovely wife is "requiring" me to take her to LoneStar Steak House for supper. I told her since it is, after all, our 13th wedding anniversary, I would do that. :D

    We got married before I decided to start my tax career or I would have not gotten married in Feb.

    I guess one evening off from taxes wont' kill me. :rolleyes:

  19. As an OH preparer, I actually see that you are catching on as to how things work here. Not only that, if you have a PY SD100, the IRS computers are not picking up lines 3 or 16, so clients are getting lots of variance letters! I have a return (and thank God that it's a relative, cause I told her to take it to her local tax office) where the client lived in Lakewood and North Royalton, paid estimated taxes to Lakewood, had income from Valley View and Olmstead Falls. Wanna try that one? NOT !
