  14. Maybe not sweat but the cost of all the materials including would be added to basis. Did he keep good records and receipts? And don't for get the appliances he is leaving and the landscaping he is leaving the cost of the road. The cost of having utilities brought in. I can't imagine he has no basis at all just because he did the labor himself. Linda and buddy
  15. I had a situation like this a couple of years ago (the stock sales of the decedent came in his name. I filed a 1040 for him and steeped up the basis with a note that the stock was sold by the beneficiary's with a steeped up basis. This flew just fine. If this is a community property state and they usually file a joint return, a 1040 mfj, checking the box as spouse filing on behalf, should suffice. But of course this all depends on weather there is any one contesting the fact that the spouse gets everything. As far as your client ant age 90 learning to pay her bills and handle all her financial needs, maybe you should suggest personal financial assistant is what she needs. This is one of the small businesses I do. I have several clients that never had to worry about paying bills and balancing checkbooks or credit cards in their life. Most of my clients are men believe it or not. The service I provide includes the client in as much of the activity as possible; picking up and sorting mail, deciding whether or not to keep a magazine sub., then I pay their bills for them on line, make the transfers from their saving to checking (bill pay account), keep an eye on their CD and stock accounts. etc.. They always write me a check, their only bill not paid on line. I charge any where from $150 to $300 per mo. depending on the time and extent I am needed. This is usually better than a relative (especially if there is more than one beneficiary for Her estate). Senior abuse is very prevalent in the financial area and just a word from a well meaning neighbor can cause all sorts of legal hassles even if there is no wrong doing, and the courts in CA anyway will just appoint a person to do what I do at a much higher fee. I do not know how she would go about finding someone in your area maybe the lawyer would know. All of my clients have come by work of mouth. Just a suggestion. Linda and buddy

    Rollover

Not necessary the bank will send them the info on an information return stating the amount of contribution. (cant remember the form #). Did They rollover the entire amount or just the amount of in the check less $3,000. Be sure the also contributed the amount equal to withholdings from their check. The company is required to withhold from the withdrawal if it is sent in check form. Be sure they included that amount. Linda and buddy
  18. They told the disabilty people it was a joint venture of husband and wife, a family business and that she could handle things and has while he had surgry. Linda and buddy
  19. Last year I did it in his name only not as joint. Don't you have to register as a partner, and do they have to do that now. or just file the 1065 and ament the return to take the sch c off and add the k1. Linda and buddy

    CP 259

The CP 259 is for no having filed a partnership return. Client is a sch c business (300K) range on net income. I had been doing his return as a joint venture checking the joint box at the top of the worksheet. 2 sch se's. This is a community property state, CA. Last year we couldn't do that any more so I made it taxpayers only. Also this year taxpayer went on state disability, in order to do that the spouse told CA disability department that it was both of their's business and that she was running the business while he was unable to work. Now they get this form. Since they never registered as a partnership can the IRS just arbitrarily make them a partnership. and how would you answer this letter. Linda and buddy
  21. That is my belief. You can file the 2009 and you can amend back 3 years. with new ss#. as bcolleen says the efile might not go thru. Linda and buddy
  22. I'm with Margaret. I have clients that send me invites to join their face book. Hell I just got text on my cell this holliday season past. I started getting text mesages and after some research from my son he determined they were from a few clients with Holliday wishes. So I did breakdown and add minimal texting to my cell account. But Facebook is a whole nother matter. No plans at all to put my mug out there in that cyber storm. So the count is growing. and neither is buddy Linda and buddy
  23. Thanks Lion I thought they had to be sent by February 15 for some reason. Linda and Buddy
