  1. Different states have different requirements for being considered a common-law marriage. But I think all of them require that the couple 'hold themselves out as married'. Filing a joint return is one of the ways you 'hold yourself out as married', so if they ever do file that way, they can not switch back to single without getting a divorce. But simply 'living together' does not, in most states, meet the test. If they own property jointly, looking at the documentation will tell you whether they bought it as "Joe Blow, a single individual, and Mary Jones, a single individual" or as "Joe and Mary Blow" or as "Joe Blow and Mary Jones, a married couple". Either of the latter two would constitute 'holding themselves out as married', and make the only options MFJ or JFS.
  2. Actually, while taxes are often unfair, in this case, if he got the money paid to him, and he turned around and paid her, he had the income, so he has the tax. Actually, his mistake was in paying her from his funds, instead of just telling her she'd have to get that money from the pension, not from him.

  4. Actually, while it was set up for ATX users, we do have a number of members who use other programs. We don't mind that at all, we help each other where and when we can. But if you use a different software, it's best to identify the program, because otherwise we assume you are talking about ATX forms. Clearly we can not know what your program does or does not have, but at least you now know that the forms themselves do exist, so if your program does not have them, you should check with the company as to when they will be available.

  7. Darn it Tom, you just make too much sense! I think YOU are right, and I was wrong. What I get for firing that off without really thinking about it. Effectively, he just made her a loan until she got her pension payments started, so he might try convincing her to repay him, or to allow it against future alimony payments. [Yeah, good luck with that, right?]
  8. The one question not clear in the original post is what is his relationship to the company providing the 'prize'? If he was just a customer of a store that had a contest, then it's clearly a prize, taxable but not subject to SE tax. BUT if he is an employee of the company that makes the product, or an employee of the company that sells the product, that creates a different issue. Then, it MIGHT be SPIFF, or it might be compensation subject to SE tax.

  15. While I'd be advising him to look into spending a little more to sharpen up the place, I'd have no problem at all taking the deduction given the facts as listed.
  16. Sure, call the state efile help desk, and ask them to look up the return in their system and help you figure out what needs to be done. My state's help desk is staffed with really nice helpful people. Bet most of them are. They want us to efile, so they tend to be helpful about fixing whatever problem may occur.
  17. Had that problem a couple of years ago, until I updated my .NET 3.5 files. That's basically a computer problem rather than a program problem, so you might want to get your local computer geek to come help you fix your computer files.
  18. I found the AZ, VT and the AL forms, no problem at all. They are available now.
  19. The question is 'why there instead of where he lived before?' If it was because of a medical reason, [example, old residence had stairs he could not handle] then any EXTRA cost of the new residence might be justified as a medical necessity. A doctor's letter supporting this could be enough. But either way, the normal costs would not be deductible, only the excess.
  20. No, the IRS does not care about the sequence, nor do they relate them to number of returns filed. They just have to be unique to the taxpayer. Some people, for example, have Preparer #1 use the DCN starting with zero, then Preparer #2 starts with 500, and Preparer #3 starts with 1000. That makes it easy to see at a glance which preparer did which returns. Others use the same method to keep up with which COMPUTER they prepared the return on, like if they work at home as well as in the office. That way they make sure they do not accidentally use the same number for two different clients.

    Which billing method box do you have checked? The top of the page shows LAST YEARS BILL. That should not change. But the changes you mention would not change the Total on the options page, but WILL change the total on the Invoice tab.

  23. That is weird, mine changes to 'created' as soon as the fed is acked. I'd call tech support, or use the email to ask them why your 'release' part of the process is not working.
  24. You ignore the LAST NUMBER, WHICH IS THE SAME FOR EVERY RETURN, relates to the filing year. So your numbers are Return #1... Fed ends in 0, state 2 Return #2... Fed ends in 3, state 5 Return #3... Fed ends in 6, state 8.... Seems like you are losing one between the fed and the state. Does not matter, they do not have to be consecutive at all, just unique.
  25. Back in the 'good old days' when ATX was still ATX, you could do that, but now the corporate gods that be protect us from ourselves, and took out that ability. HOWEVER, what you could do is go to irs.gov and download the pdf form, fill it out and print it and add it to the forms the program will let you print. Since it's a paper return, no one will even know you did that.
