  2. I completely agree with lbb. Plus, when I choose to go into the general chit chat forum it tells me right there "Discuss taxes, software, anything you want." Some are just choosing to discuss anything they want and I for one don't have a problem with that.

  4. Have a client who just received a 1099-Misc box 7 with 5K in back vacation from a company that closed down a couple years ago. No SE tax correct? It was from a settlement when he filed a complaint with the state. He was a W-2 employee when he was employed there.
  5. There are here as well in southeast Michigan. I just saw one standing outside today in the snow while lighting up a cigarette. I just had to laugh.
  6. It isn't ATX on those forms, but they are lagging behind on some of the other forms.
  7. I agree on that cost estimate if not even higher. I would also be interested in this as well, but if there is a potential of 2 years before the software would actually come out, you have a lot of salary and other expenses to pay out before there is any income.
  8. So you are saying that if someone lives in Texas and there was a check cut in California that the person had no control over the funds, it is constructive receipt because the check is available. That would surprise me coming from you. You seem to be an aggressive and very knowledgeable preparer (from what I remember on the old atxers board) and I would think that this would be one area that you could definitely argue your side successfully. I also didn't say to rely on the postmark. Just to look at it and see when it was actually mailed. It may shed some light on when the company actually sent the check.
  9. If client was in Texas and the check was in California, I don't think it was unreasonable that he didn't go and pick up this check. Check the postmark date on the envelope it came in (if that is still possible). It may not have been mailed until 2008 based on when your client received it. I would say it is 2008 income, but if a 1099 does say 2007, it may not be worth fighting over.
