Have had Federal returns ACK, and Ohio return IRS approved. However as of this past Saturday have not received any ACK,s from Ohio. Is any other Ohio preparer having the problem. Thank you, Jeff

As of 5:00 p.m. ATX server has been down. Called Tech support and they state work was being done on the server. Has anyone had a problem E-filing or receiving ACKs. Thank you, Jeff

Linda: Thank your the reply. The 1099 R shows 162,696 in block 1 and federal tax of $300. withheld. The amount they rolled over was $159,687. Would the $300 withheld be included in block 1. Thank you Jeff

Client rolled over 401K into an IRA. They were within the 30 day window and have all the documents from the bank. The return will be paper filed. My questions is this: Should the bank documents be attached to the return showing the dollar amount placed into the IRA. All except $3,000 dollars was placed into the IRA. Thank you, Jeff

Question on form 8863 Parents are claiming the American Opportunity credit on form 8863. The student is their dependent child and under the age of 24. May they take the refundable part of the credit or should the box be x on line 15. Have read the instructions on pg. 5 and they are not very clear. Our the instructions on pg. 5 talking about the credit being claim on parent's return on the student's return. Thank you Jeff

Thanks everyone for your replies. Have read everything I could find on the matter. I know in states that you cannot take a deduction if you inherited the house, but I have not been able to find anything on this situation. Next step is to call the IRS. After I find the correct answer I will post it. Thanks again Jeff

Fact Pattern: Taxpayer inherits one half of father's home/ stepmother resides in home and owns the other half. Stepmother dies and other half of house is willed to her children (TP stepbrother and sister) TP purchases other half of home and moves into the home. Before the purchase TP was renting another home, and has not owned a home in the past 3 years. May the TP take the First Time Home Buy Credit for the amount he purchase the home? I believe he can take the credit since this became his Principal Residence. However, I would greatly appreciate any input one may have on this issue Thank you, Jeff

Client and son purchased a new vehicle together. Vehicle is titled in both of their names. The client is solely responsible for the loan on the vehicle. It should be noted that the son is an adult and will file his own return. My question is this: who may take the sales tax deduction? Thank you, Jeff

Will be working with two different types of software this year on the same computer TRX (Tax Works) and ATX 1040. My question is this, may I E-File using both systems with my EFIN number? Or will this cause a problem. Thank you Jeff

Have a client that has additional Stimulus Money coming, however I made a mistake and placed a zero on line 70. Can this return be amended so that she will RRC credit? Thank you, Jeff

Have a client that used a vehicle for business use and had taken the standard milege deduction. However, she traded the vehicle in for another that will not be used for business. The Fair Market Value of the vehicle when placed in service was $7,000., a total of $4,385.21 was depreciated, and she received a trade in the amount of $3,000. The over all percentage of business use for all the yeas was 29.74%. Since this is not a Like Kind Trade how do the calculate the sale of the vehicle so it can be report on form 4797. I have never had a person trade a vehicle in that will not be used in the business. Thank you, Jeff

Couple are separated (no legal separation from the court). Wife would like to file married filing separate. She will not have a refund nor will she owe anything. On the other hand, husband will owe a great deal to the IRS. if filed MFS. They have been separated for some time, and in past years agreed to file married filing joint. However this year the wife would like to file MFS Since there is not legal separation can the wife be held responsible for the amount the husband will owe IRS on his return? Thank you, Jeff

Client's retrun has been E-Filed. However, he sold his home last year and received a 1099 S. The sale was not report on his original return. To be in compliance in reporting the sale can I amend the return and report the Section 121 exclusion the Schedule D? Thank you, Jeff

Taxbilly: He is employeed by the union, however he is not reimbursed for the meals or the entertainment. Since he is a high level union offical (VP) I believe this would be part of this job assignment. Need help on this one. Thanks you Taxbilly
