neilbrink
Error report says "Form W-2, Line B 'EmployerEIN' was issued after the Tax Year in the Return Header". Employer is a farmer and was going to issue 2013 W-2s using his social security number. Instead he was issued his EIN in January, 2014, and used the EIN for the 2013 W-2 forms. Am I assuming correctly that he needs to redo the W-2 forms using his social security number? His W-2 infomation has already been efiled with and accepted by Social Security using the EIN. So evidently, Social Security is not concerned about when the EIN was obtained, but the IRS is. Does anyone have any experience in handling a situation like this? David1980
Issuing W-2 using his SSN won't work either. What the farmer should have done was obtained an EIN in 2013 if they knew they were going to have employees. At this point I think the only thing you can do is paper file the return for anyone who has a W-2 from that farmer. From W-2 instructions for box b EIN: Do not use a prior owner's EIN. If you do not have an EIN when filing Forms W-2, enter “Applied For” in box b; do not use your SSN.
Jack from Ohio
Paper file is the only alternative. And get ready for notices, etc. All employees will have to paper file as well, they will get the same rejection. I'll bet he never called you before starting employees, did he? neilbrink
So why did the IRS accept the farmer's form 943 that was efiled with the EIN? And also, the W-2s with the EIN were accepted on-line by Social Security.

You could call them and ask. 1-800-829-1040

Employees wont be able to efile for this year or next year. You don't need to amend anything but all employees must paper file for the next two years.
