I don't think so because there is a court appointed representative. can I e-file this? when I try to create - it says if there is a refund then a 1310 must be inc. with box c checked(which isn't correct). thanks for any help on this. mcb39 Posted March 30, 2009 Report Share Posted March 30, 2009 For some reason, I don't believe you can e-file when the death is in the current year.; only if it occurred in the tax year you are preparing. ie: 2008.....deaths in the tax year do require a 1310. So long as the death has been recorded in the IRS records, it'll fly. Except I don't think the IRS allows a 1310 for e-file with a court-appointed representative.
