  2. First, delete, or move to a backup all files. Even though files are deleted, or moved, they can still be recovered. So, the next step is to bleach the disc with software that overwrites the disc with zeros. www.killdisc.com or anyother bleach software does this. There free versions.

  3. As I posted before, the only way is if the S Corp borrows the funds directly in it's own name.

  4. Did you read my first post ? It is a big problem if you do it this way ! Unfortunately, there were several later posts that wandered off into the weeds and confused the issue.

  6. Today, the mother said the wrong SSN is actually the EIN for Colgate, which might be what happened. However, the 1099-Q has a box to check if the distribution went to anyone other than the beneficiary; so if it went directly to Colgate, that box should be checked -- and is not. Anyway, it is their 529 and they did take a distribution to help with tuition and mom knows an incorrect SSN is listed for her son. We'll know what happened if we get an IRS letter. Just hope some innocent bystander doesn't get a letter for not reporting a 1099-Q distribution! I have a very small farm in IL that my grandfather bought in the 1880's. I have a sharecropper who also pays me a little bit of cash rent. Each year, he sends me a 1099-MISC with a wrong digit in my SSN. Each year I tell him my correct SSN. Each year is a different error in my SSN. I'm reporting all my income. But, random innocent bystanders are probably getting IRS letters.

  7. Correct name, wrong SSN! Possibly an input error. One possible scenario - input clerck started on student's info, took a break and flipped over form; came back and saw on screen cursor in SSN field; continued from ther inputting wrong info. I discovered something like this when a was the reviewer of CP2000's for HRB . Employer had issued two different W-2's on the same page. One had the correct person, the other was for a different employee. Preparer must have though they were duplicates and carelessly entered the wrong one. Since the correct one hadn't been reported, it triggered a CP2000.

  9. Thanx, all. Yep, I already roughed out a spreadsheet for my calculations: $55,000 tuition - $40,000 grants - $1,700 CHET 529 plan (only $200 potentially taxable) = plenty for AOC. Parents are older (adopted kids from China) and dad now has dementia and can't work, so they will qualify for the AOC. I'm entering in my electronic notes to the parents' tax return, as well as the student's. Just to add to the complexity, the 1098-Q has the student's name but a SSN that does NOT belong to anyone in the family, totally different digits.

  10. Yes, Wage & Income transcripts are available for 10 years. They will have everything that was reported by 3rd parties (except for state information). The transcripts can be gotten over the phone, but they IRS no longer faxes them. If the clients was married in 2010, the spouses transcript should be obtained as well. Ram32 said "the IRS created the missing personal return ". That would have been the SFR.

  11. I am not sure I get what is annoying about the neighbors. Is it the cigarette smoke, or the constant mumble of their conversation? There are things that can be done to remedy the situation, but they may be more of a bother to you, such as having a smoke alarm that keeps going off and having to be reset. It is a good idea to have a smoke alarm, anyway. I am surprised thay are not required. If you have renters insurance, the company might give you a discount for having a smoke alarm. If it is low level noise they generate, playing loud music can drown out their conversation. That's how my roomate and I silenced some noisy neighbors that moved in upstairs from us. My roommate had a very powerful stereo system. So, we mounted a large speaker on the top of a bookshelf, inches from the ceiling, and turned it up full blast. Never any problem after that. Goodluck with anything you do.

  12. We have gotten a lot of IRS letters for clients who had 529 distributions and claimed the AOC. I think it was one of those areas they decided to focus on for a couple of years. Just keep copies of the reporting docs and a worksheet showing the breakdown of where the money went to prove that you weren't using the same qualified educational expenses for the AOC and tax-free distributions. This obviously didn't happen in your case, but you never know what the IRS computers were "taught."

  13. Your local fire department might know which brand/model is the most sensitive and the loudest. It's worth a little time searching. Install them as high as possible to make it hard for your neighbors to remove the batteries. Or, hardwire them in. Your neighbors won't want the baby crying or the toddler throwing a tantrum.

  14. We were trying to get gas service at our new address, and the company does a soft credit check with Equifax of all places. So I unfroze my credit for a few days. This is the only credit bureau I can't do online (it just doesn't work) so I did it over their automated phone system. Called back the utility, still frozen; waited a few hours and called again, still frozen. I had a confirmation number from Equifax but what good could that do me??? I called again today, a few days later, and they got the info they needed so I didn't have to pay a $375 deposit. I asked the utility to deliver my complain to management that they are still using Equifax, the very reason we froze our credit in the first place. I had to unfreeze all three credit bureaus when we bought our new home, got insurance and other utilities, and all went smoothly.

  15. What your client should do to comply and substantiate the S Corp(s) interest deductions and maintain basis: 1. Take out the HELOC with proceeds deposited in his personal checking account 2. Loan the HELOC proceeds to the S Corp(s) 3. Document the loans with the proper interest rates, repayment schedules etc. 4. Make sure that the S Corp(s) repay your client every month on schedule, issuing 1099INTs at the end of the year. 5. Your client should make all the HELOC repayments from his personal checking account. Clients usually want to create shortcuts i.e., make it up as they go along ,which in your clients situation is a recipe for lost deductions etc., etc ! I will leave it to others to mention cites, case law etc.
