  1. Civil service employee had 46000.00 total contributions as shown on the 1099R. He had been recovering the investment over the years and then passed away in 2007. According to page 5-17 of QF, it states that UNRECOVERED cost of annuities is to be recovered on the decedent's last return. Have client that went to J-Hewitt and rather than recover on Sch A (surviving spouse was able to Itemize), they continued to recover the cost on the 2007 and 2008 tax returns. Do we have the option of going either way -- continuing the recovery as was, or should they have taken the balance and placed on Sch A? Thanks
  2. No Social Security - If she had then it would have been easy to track down such payments. She is in her 80's and I'm certain that when her husband was active that they wern't witholding social security. I was thinking that in view of the last sentence under GOVT RETIREE CREDIT - 2009 Instructions for Sch M (or pension benefits) that she would qualify for the 250. credit, right? Thanks
  3. Have client(in her 80's) who has been receiving Civil Svc 1099R with Code 4 - does she qualify for the Govt Retiree Credit on Sch M. I haven't been filing tax returns for her as she is below the filing requirements. In reading the instructins for "Govt Retiree Credit (page M-1) says "you may have received an economic recovery payment if you received............or pension benefits - this is a pension benefit, so I figure she should be elibible for the $250.00 credit? Will this work? Thanks...
  4. I have done one state return for MA, CA & CO - Am I required to register with these states in order to do these returns? I'd suspect they would have a minimum number before registration would be required? Thanks

  7. Taxpayer receives 1099-Misc, Box 7 with 2100.00? I think it should go in box 3 instead. She has been taking pills under a voluntary medical research testing program. She signed up to participate in the program - took these pills for nearly 1 year and gets the 2100. and its placed in Box 7 and not box 3. The organization tells me they have been doing it this way for the past 10 years. In looking at the IRS instructions for Box 3 entries it says: "Prizes & awards received in recognition of past accomplishements in SCIENTIFIC AND EDUCATIONAL are not reportable if the winners are chosen without action on THIER PART - but she did volunteer? Anyone know how I should handl this? Thanks
  8. Is the Confidentiality Agreement kinda like a consent for disclosure of tax information pursuant to IRC Section 7216, or is it intended for something else?
  9. I always use IRS Pub 584 (Personal use Property) and 584-B (Business Use Property). These Casualty Workbooks are an excellent starting point for such casualties. Try them, I'm certain you'll be satisified.

    Royalties are entered on the Sch E worksheet - and the depletion expense line is on the worksheet.

  13. Have client coming in today moved from CO (Part Year Resident). Single, rented while in CO and has no dependents. I note CO has numerous forms but I didn't see any PART YEAR forms. He moved from CO in March of 2009. Is there anything that I should watch in doing this return - have never done a CO return. Will appreciate any advice. Thanks...

  16. I received he same rejects and called the e-file hot line and they said several calls had been received by them on the same reject. Said they will call me back when resolved. The odd thing about this is that I e-filed 4 returns and all cleared except the one. I'll post their answer when received.
  17. Go to Preferences, click on ROLLOVER MANAGER, then make certain that you checkmark the bottom two (default preparer & ERO) and your name will then appear on the 8879.

The AARA of 2009 clearly states that if individuals WERE ELIGIBLE, REPEAT, ELIGIBLE, for the particular benefit shown below "AT ANY TIME DURING THE PERIOD NOVEMBER 2008 THRU JANUARY 2009" they will receive the $250. payment: a. Adults eligible for Soc Security Benefits, RR benefits, or veterans compensation or pension benefits. b. Individuals of ANY AGE, repeat ANY AGE, eligible for SSI benefits, other than those receiving SSI while in a medicaid institution. c. If the individual is eligible for the Making Work Pay Credit, that credit will be reduced by the 250.00. d. Payments will be made by the SSA as soon as practical but NLT 6/17/09. (Act 2201). Recapping the above, this would mean that 'OLD TIMERS' WHO HAVE BEEN OR WERE RECEIVING SOCIAL SECURITY BENEFITS PRIOR TO NOVEMBER 2008 WOULD AUTOMATICALLY BE CONSIDERED AS HAVING RECEIVED THE 250.00 BENEFIT PAYMENT. For the 'SHORT TIMERS', THEY WOULD ALSO AUTOMATICALLY BE CONSISDERED AS HAVING RECEIVED THE 250.00 BENEFIT PAYMENT - IF THEY QUALIFIED, REPEAT QUALIFIED FOR THEIR PARTICULAR BENEFITS DURING THE PERIOD OF "NOVEMBER 2008 THRU JANUARY 2009" For the 'NO TIMERS', IF THEY BECAME ELIGIBLE FOR THEIR BENFITS FROM "FEBRUARY 2009 THRU DECEMBER 2009, THEY WILL NOT GET THE $250.00 BENEFIT PAYMENTS.

In reference to my earlier posts on this subject: The following details were taken from the SS website: "The ARRA OF 2009 provides for one-time payments of $250.00 to individuals who WERE, OR ARE FOUND TO BE ELIGIBLE for Social Security and SSI benefits during any one of the three months (NOV 08,DEC 08 & JAN 2009)." Thus, if they became eligible FEB 09 thru DEC 09 THEY WILL NOT BE RECEIVING ANY kind of stimulus payment. "Individuals are only entitled to one payment regardless of how many types of benefits they receive. For example, if an individual receives any combination of SS, SSI, RR or Veterans benefits, they will only get one payment. The agency will issue one-time payments through Dec 31, 2010. NATP has confirmed what I've stated above.
  20. Ref Taxbilly's post: Thats the way its stated. If during the months ov Nov 2008,Dec 2008, or January 2009 then they had to get the 250.00 unless the IRS kept the money for other debts. This info is in Tab 16-5 under ECONOMIC RECOVERY PAYMENT. Ref JohnH: The 250.00 relates to those receiving SS from NOVEMBER 2008 THRU DEC 2009. They would not have received the rebate if BEFORE NOVEMBER 2008. Read my post again, it's NOVEMBER FORWARD - Not prior to NOvember 2008. The Payments were to be received by everyone eligible during May or June 2009.

If you have a copy of the 1040 express answers for 2009 tax year, it says the 250. will be received by adults if DURING THE MONTHS OF NOV 2008, DECEMBER 2008 OR JANUARY 2009 the individual person was ELIGIBLE to receive SS benefits, SSI, RR Act benefits or veterans compensation. Therefore if they have been receiving their benefits ALL YEAR (2009) they received the 250.00. I received the benefits all year and both my wife and I received SEPARATE deposits for the amounts. In addition we received a letter from the SSA which stated that this is a SEPARATE payment and is not included in the monthly benefits. The letter also states that the Dept of Treasury will offset these one-time payments to collect deliquent child support and debts owed to state and federal agencies. Regardless, each eligible individual has received a letter from the SSA explaining this payment. Just make certain you advise the clients in advance to bring the letter in - however if it appears they received the benefits ALL YEAR then you can feel fairly safe to know they did receive the payment. Hope this helps some!!

    Organizer

    The 2009 ATX program has a Tax Check List that you can use instead of an Organizer. Just add new forms, stating "Checklist" and there it is... Hope this is what you were looking for.

    SSAN "SOS"

    I read this in the Readers Digest - Oct 2009: "As if we needed another reason to worry about identity theft: Researchers at Carnegie Mellon UNiversity have discovered it's fairly easy to guess the first six digits of a person's SSAN if you know the birth date and hometown. That's because there are chronological and geographical patterns to the numbers. The Social Security Admin is working on a method to generate randomized numbers" I suppose with all the new technology out there it can be done!!
