It's amazing...hours, days, weeks, months can go by and I still almost always agree with "Old Jack" Substance over form differentiates tax law from State law; original poster stated taxpayer wanted to refinance his home so that his daughter could get a "better interest rate" In my never humble opinion refinancing one's own home to allow one's child to use the equity to obtain a better interest rate is not an investment, but up here in the far North newfangled ideas don't get to us much. lbb

  9. Work credits for disability benefits The number of work credits needed for disability benefits depend on your age when you become disabled. Generally you need 40 credits, 20 of which were earned in the last 10 years ending with the year you become disabled. However, younger workers may qualify with fewer credits. The rules are as follows: Before age 24--You may qualify if you have 6 credits earned in the 3-year period ending when your disability starts. Age 24 to 31--You may qualify if you have credit for working half the time between age 21 and the time you become disabled. For example, if you become disabled at age 27, you would need credit for 3 years of work (12 credits) out of the past 6 years (between ages 21 and 27). Age 31 or older--In general, you need to have the number of work credits shown in the chart below. Unless you are blind, you must have earned at least 20 of the credits in the 10 years immediately before you became disabled.   10. As usual, you neglected an important part of the statement. So are you stating that Americans who work full time should live in poverty? Are you saying that only the members of the lucky sperm club are entitled to a living wage? Your statements sound as if you belong back in the feudal system. It sounds like you are saying if you are born into a family that encourages and supports you to have minimally an undergraduate degree you are worthy. If you are born into a family that's poverty ridden, you are just going to stay that way. I thought you right wing zealots were big believers in personal responsibility. There are thousands of Americans working full time, live in poverty, and have to medical care. What's there incentive to keep working? Too bad for them? I've got it, you don't like Hillary Clinton. You are right wing. You are Republican. When did this new site become a zone for the ultra conservatives? I haven't had time to read much lately, (putting in a new computer system) but I used to have a lot more respect for you KC when you talked about tax. I agree to disagree.   11. Gee, and all I usually read about SS on these boards is how to avoid it. In the past when I brought up situations like the one your client is encountering the knee jerk reactions about how stupid it is to pay Soc Sec and Medicare are thundering. If your client had paid into the system accordingly, he wouldn't have to be committing fraud now. What is the difference between falsifying income figures to qualify for social security and falsifying income figures for EIC? They are both entitlements, which according to this board most of you want to get rid of. If he wants to claim more income tell him to earn it. lbb

  13. But if I take the full $5000 as Sec 179 it won't change any depreciation taken in 05 & 06? If you haven't prepared 2005 or 2006 there is no problem, but if asset was depreciated in 2004 there would have carryover depreciation in 2005 and 2006; if the asset was simply left off the return you don't have carryover issues. I thought you were amending to Sec. 179 asset, not add asset (easy error on my part.)
  14. If you do that you will have to amend 2005 & 2006 because of the carryover depreciation.
  15. You shouldn't have to worry about this today! Your post confused me, if he moved to Michigan, then wasn't he a part year resident? IF you filled out the NR correctly you would have split his income between Iowa and MI, you wouldn't then have ALSO received a credit for taxes that he paid when it wasn't taxed in Michigan on the Iowa income. Michigan is mercilous, broke and run by computers; good luck!
  16. I'm sorry about the previous post, I'm still getting used to this board. With such small amounts of audits preparers put a LOT of items on returns that they know won't fly. All you can do is what in your professional opinion is correct. I don't understand these couples that go to separate preparers anyway; it's almost like they are shopping for opinions.
  17. I've seen other people post the same as JohnH, but in my experience the government NEVER pursues on a 4137 that's what the SS8 is for. So file the 4137 as advised, pay employee portion of SS & Medicare, and go home.
  18. If the taxpayer never deducted them in previous years, the return of the fees would not be taxable.
