MFJ to MFS

Client wants to change from MFJ to MFS.

It seems to me that this is not allowed?

Just verifying that I am right.

Maybe I'm brain dead in the south but I don't see why not as long as both parties give permission and you amend? KBID 9521 doesn't expressly forbid it, at least. Of course I have not been a preparer in some time though, so the IRS' mileage may vary.

If this is a 2008 return they can if they do it before April 15th. If it's any other year they are stuck. They can go from MFS to MFJ anytime within the three year statue of limitations period.

Thank you Deb, I was sure that was the case. I guess I'm just not trusting my self while I'm so rumdummy, this late in the season.

And by the way this is for a 2007 tax year. AND he just brought in his 2008 Exteennnsioooon.
