    Deceased Spouse

Client's spouse died in February of 2007. They can file as MFJ still. The software is requiring a pin for the 8879 for the deceased spouse. I have the date of death listed on the Filer's info page. What am I missing?

    Short Sale

I'm showing some ignorance here but hope someone can help me. What is a short sale? I have several clients who have these listed on stock transactions. I notice that ATX has it listed as an option on the input sheet. Should these be input any differently? I also notice the acquisition date is after the sale date. Please help educate me on this. Thanks.
  4. I would put it on line 21 as a negative amount with a statement attached to return explainng the adjustment.
  5. I too have these GM retirees. Problem is ATX will not allow these to be e filed. If it is life insurance, the uncollected code is such that it can be e filed. However, when code M and N are used, the system won't allow it. What do you other prepares do with these returns? Is there a way to input so that they can be e filed? Thanks
  6. I had a similar situation a few years back. My client chose to let the lawyers settle it. Husband had to give 50% of refund to wife. If the husband e filed the return on line, did he really "forge" the wife's signature. It is wrong of them to file without wife's knowledge, but e file makes it too easy. Also, it brings to the forefront the need to settle those dependency exemptions in court. My client will not give up those exemptions, even though she doesn't have much taxable income.
  7. That's what I thought but wanted to be certain. Second home does indeed mean vacation home.
  8. The points paid on the initial purchase of second home - are these deductible as mortgage interest? They were reported on the Form 1098. Thanks.
  9. The depreciation on home office is not showing up under asset entry. I even selected all for the assets to display. Am I inputing this information wrong? It is input directly on the Form 8829 and calculates a small amount of depreciation each year. I went back to all returns and got my number for this client. But that is not always feasible. If I need to change how I input this, I would like to know. Thanks for the guidance.
  10. Client sold home on which depreciation had been taken. How do I find out the total amount of depreciation taken on the house? It was always in ATX tax program. I just don't want to have to pull each return. It should be there but I cannot find it. Thanks!
  11. I too am having the same problem. I need ATX to fix this as it is holding up 4 returns. This time of year, I need to move the returns out of my office and not have these type of delays.
  12. Based on another post on the general chit chat, this is a new problem with the update to SE. Hopefully, ATX is working on resolving this issue.
  13. Prior year the client had unreimbursed partner expenses and the e file went through. 2007 program is telling me becuase of the UPE, the return must be paper filed. Did the IRS change the rules regarding UPE's?

    1099-Q

No, there were no pell grants or the like and the AGI limitations are still there for tuition and fees deduction. Mom makes good money and files Head of Household.
  15. That is correct. The only clients that have received the coupons are ones that were paper filed in 2006.

    1099-Q

A client received a 1099-Q for distribution for amounts used for daughter's tuition. There was no education credit claimed as the client is above the AGI limits. Is it correct that there is no reporting of this on the tax return? The education costs exceed the amount of the distribution. Thanks for guidance on this issue.

    HSA

I have a client who has an HSA. My question is regarding the deduction. His monthly contribution was 149.60 with abount 100 going for premium and 49.60 going to the savings portion. Is the full amount deductible as contribution or just the savings account portion. I'm confused. Please help.
  18. For those interested, the client is an attorney. He did indeed file the annulment in the courts. Thanks for the information fromt he publication. that is very useful.
  19. Client was married on 6/16/07, separated on 9/1/07 and the marriage was annulled in 2/08. Is Married filing separate or MFJ the only options for 2007? Client was surprised this would matter.
  20. The 1098 shows mortgage insurance premiums paid. However, this is a rental property. Are they deductible or is it considered basis?
  21. Three single clients bought a house together. All three are listed on the deed and all three are liable for the mortgage. However, the 1098 only came in one person's name. I plan to e file all three returns. Should I report the mortgage interest on Schedule A Line 11 for the two owners who are not listed on 1098 and report reduced amount on Line 10 Schedule A for the person whose SSN is on 1098? The instructions for Schedule A indicate to attach a schedule with other persons SSN and Address. Any ideas on how to accomplish this in ATX? Thanks!
  22. I'm confused on which member, if any, should be put here. The entity is an LLC. I read the 1065 directions, but am still not sure. Any guidance on how to determine if one of the members should be put here?
  23. That is correct. Be sure to review the subtractions modifications on page 2 to see if your client qualifies for any of these. It is the only way to help eliminate some of the tax.
  24. The phone call was from the tax preparer who works for Liberty Tax Service. You are correct - no taxable income but no deduction either. Thanks for helping me think this through. The brain is a bit tired.
  25. The pension act of 2006 allowed an individual to donate up to $100,000 directly from retirement plan to a charitable organization. Someone donated in this fashion to my church. The church received a phone call saying that they needed to complete a specific form in order for the individual to receive deduction. The church had previously sent a letter of acknowledgement of receipt. Does anyone know what form this would be? Any help is appreciated.
