  1. I had a phone call from a referral, the question is regarding child tax credit. the caller was a stay at home mom. No income for the past several years. Solely supported by "boyfriend". Her child, fully supported by "boyfriend". child is eligible for dependency, obviously. However, point of phone call was that HRB would not allow child tax credit. I tended to agree because of 2010 definition of child for EITC. Upon reflection I am questioning this. The child is admittedly not his child, however they are cohabiting and living as man and wife via appearances if not declaration. Not in violation of local laws. (city even recognizes domestic partner). could it be reasonably construed that the child is hIs STEP-CHILD in that he voluntarily provides all of the child's support and they live as man and wife? Fortunately not my client but I would like to know thoughts as I am sure this is prevalent in today's society and do not want to run afoul.

I also wondered if they could not be MFJ even though the state does not recognize "common-law marriage"

(see what happens wHen software does not work and IRS does not accept returns, Start borrowing trouble"

  2. If your computer is more than 3 years old, your computer may be to blame.

    Computer hardware is cheap.

Find a techno-geek and hire him to help you set up the new system you buy.

Buy a system with the fastest processor available, at least 4GB (Best is 8GB) of RAM and Win7 (not Win8).

This will eliminate many of the issues with the software.

I appreciate the input but Have one new computer, one 2 years old and one 3 years old with all the bells and whistles. Everthing else works but ATX 2012 does not work anywhere on network. 30 minutes (so far) waiting on tech support.
  3. I still cannot open my return, Only thing I have successfully accomplished is one Sales tax return. Still takes five minutes to open a return and on my own 1040 it still "crashes the "shell" whatever that is. I am a tax preparer, not a computer whiz. I may be getting senile, but I believe that this is the worst in the 15 years or so I have been using ATX. I appreciated all the improvements over the years ( if not the price increases) but I have never not been able to install the program and use it. Suggestion from e-mail support was that it was just my computer. I have tried it on all 3 of my office computers with the same results. cannot even get staff prepared. FRUSTRATING

  4. >>HR 4646 has been replaced in the New Congress<<

So what? They haven't even passed a BUDGET since 2009. What are the chances of a total restructuring of our entire tax system this year?

I personally do not think it has the chances of an Ice Cube in Arizona but we have to have Reps who need to put somethng in the hopper to justify their existance. LOL

  5. Post the link??

Mu daughter got a letter from IRS regarding her PTIN that she got years ago. She did one return lastt year for a friend and dutifully signed it. She now has to register for the new PTIN, payt the $64.00 (retroactivivly ) for 2011 and also renew PTIN for 2012 and pay the $64.00. I believe that is where the 100,000 number came from.

  6. >>being proposed and passed around to various committees<<

Get real! "Google" is not a legitimate source

for tax research. This bill is NOT before the current Congress, and died in committee in the prior session. The same can be said for hundreds of bills sponsored by both parties without any intention of passing, to score some political points but mostly to distract political opponents from genuine legislation.

I can tell you never paid any attention to what H.R. 4646 really said, because it would NOT have been "repealed after 2017." That was the phase-out period for the current income tax and AMT system, eliminated entirely by applying a 100% credit for any transaction fees paid.

HR 4646 has been replaced in the New Congress by HR 1125. Intro last March, no action as of last week.

  7. You are correct. Divorce not final until early 2011. Just living apart 12/31/10

NOt a ruling but: one of my clients went for homebuyers credit, disallowed because 1098 in his name in the previous 5 years. turns out it was rent to own scam, and the seller got him a new loan in 2010 and 1098 had been going to "seller". IRS concludes that he was a homeowner. I suspect that the same will be true in your case. Probably able to battle it but at what cost?

  8. I stay with fee collect, the western union card seemed attractive but I was told from multiple sources that it is considered a bank product and can not be used if you are using fee collect.

Also be aware that the transaction fee for western union is $1.75. If the tp uses it as a debit card then fees could be excessive.

I am aware that I am not their keeper but I do try to stay within moral bounds, (no RALS)

  9. Anyone taken advantage of ATX's i-transact offer re credit card processing?

If so, details and comments would be appreciated.

    Thanks, Lynn

They called me and the first part was that I offer the service to my business clients and I get a residual fee. The second part was that they would do my processing cheaper than anyone. I asked them to do a comparison to my current processor, sent them 3 months of statements. Have not heard back.

  10. I received the envelop and immediately stuck the disk in my server. told it which drive and folder to install to and it did. All returns and info from 2009 rolled over, all prepareprs and netsetup done. Only issue is that all the forms are still draft.windows server 2003, workstations windows 7

  11. I am researching new computers, and have the option of a Windows downgrade to XP Pro with Windows 7. I don't know if it is necessary or if it's just a good idea to have that option. I am using XP now. I know that I can have one built, but I have used my warranties a few times with Dell and they have more than paid for themselves. They have always had me back in business quickly. My longest wait has been when I have had to take my computers into a local shop. I leave the desktop on 24-7, so it does get a lot of use. I love my Dimension 8400, but it is over 5 years old and is starting to act up. Thanks!

We have Windows 7 on 2 machines now. My concern was my lagacy ATX software. We have only tested it on 2007 thru 2009. Works fine in a networked enviroment. HP does provide drivers for HP laserjets 4000 series as well as HP Laserjet 1200. I do not know about my old scanner yet. Project for the coming week. Do get as much ram as possible. WIN 7 evidently will use 4 gigs of ram

My experience only. Not a professional computer tech.

  12. YOU always have the option of not taking them on. I would never certify my client filed a return, even if i efiled it they could have amended it themselves and hour later. the banks should verify the taxes with the irs not the preparers

My experience has been that they wanted a letter stating that we had prepared their return/s for year in question. I would not use verbiage that we had "filed" return

  13. >>transactions with dates " purchase 01/01/08, sold 12/31/08"<<

Why not just use lines 2 and 9 in the normal way, so as not to draw attention with entries that don't match the 1099-B?

I used all inclusive dates to allow for e-filing and not entering the "hundreds" of individual transactions. Seemed to have worked so far. No inquiry from Service.
