  1. I do not answer questions that are rhetorical and only meant to stir up trouble. The payroll program will not import or export to Drake, the program that jshtax has chosen for 2013. I grow weary of the intentional sniping at ATX. If I were to choose not to honor my NDA with CCH, my answers would keep those "snipers" from posting.

  3. No one is requiring you to use the payroll program. It isn't compatible with the Drake you are using.

  5. You keep believing that. Let me know, when the compliance auditor visits, how that line of thinking works for him/her. Everyone should read/see some of the seminars that Karen Hawkins, Director of Tax Preparer Compliance for the IRS, puts on and listen to how she is directing her department to do things.

  7. MDEA is correct. Karen Hawkins will eat you alive if an incident like this gets to her. Try that defense on the compliance auditor. Let us know how that works.
  8. Another thing to keep in mind, if you require documentation for a few of your 8867 clients and not all, you fall into the "know or should have known" area of Circular 230. If you do not treat all 8867 clients with the same level of scrutiny, you are waving the red flag. Karen Hawkins is a no-nonsense and totally aggressive person in these areas. She will pull your PTIN at the drop of a hat if she suspects such things. I heard her speak at the IRS Forum in Atlanta. She scares me!!
  9. She will only qualify if she can document 750 hours for EACH rental (unless she bundled them). I disagree. I do NOT think she qualifies. She would have to spend 14 1/2 hours each week. For 2 rentals, that is not feasible or reasonable.

  11. Most do NOT meet the requirements for a "Real Estate Professional." The most often missed requirement is: "The taxpayer performed more than 750 hours of services during the tax year in real property trades or businesses in which the taxpayer materially participated."

Subject: IRS Issuing Penalty Notices to Tax Preparers for Missing Forms 8867 ________________________________________ Tax preparers who do not send Form 8867 with EITC returns are subject to a $500 penalty per return. IRS sent warning Letter 4989 to preparers who did not comply for tax year 2011, and, starting this month, IRS will be sending nearly 800 of those preparers notices of proposed penalties for continued failure to attach the form for tax year 2012 returns. Get details on EITC Due Diligence at www.EITC.irs.gov.
  15. I would say you have one chance in a hundred of getting that OIC approved. Situations do not matter. Assets and living expenses are all that the IRS uses for determination. Especially for multi-year non-filers.

  18. Add Memory, then upgrade to WIN7 PRO. Microsoft sells an update disk that works seamlessly. As old as your machine is, a new machine would be a smarter move.
  19. Shaking My Head in disbelief of such blatant, outright ignoring of the regulations, and posting it in a public forum to boot.
  20. Be very hesitant before pursuing the course you are considering. Loss of returns and data are very much a possibility if not done correctly. Check your messages. Even copying those files will NOT assure you will not have data loss or corruption. Also be wary of recommendations from a person that jumped ship mid season last year and is not using the software this year.
