So they are not the brightest candle in the bunch, huh? To get a free $6500 they could have rented a motel for a week or two, or even a couple of months in an extended-stay place, with a nice profit left over !!!!!!!!!

If the partnership was named as beneficiary, then the partnership needs to inform each partner of their share of both the income and the withholding. I'd treat the partnership in that case just as you would someone who receives 'nominee income' entering it in but then deducting it out and issuing a 1099R to each partner for their share.

Larry, it's not "a non registered alien". The 1040NR is for Non Resident aliens. It has to do with whether they are in this country working long enough to qualify as a Resident or not.

Actually, it happens in most states, which is a pain. The 'work-around' for right now is to create and efile the Federal return, then as soon as the bug is fixed, send the state return as a stand alone. A few states a stand-alone will work now, but many will not. They know of the problem and are working on fixing it, so it may not take long. I'd suggest you try updating frequently, so you get the fix as soon as it is posted. OR, since this is the start of the next 'cycle', just hold the Federal return for a day, until they fix the bug, then recreate it and send it in tomorrow. Assuming not a RAL or other reason for sending the Federal one today.

Read the definition for Non-Resident vs Resident Alien. Odds are he may qualify as resident, and file 1040. If he was paid cash [under the table, so to speak] you still need to file it. But whether you use a Sch C-EZ or put it on line 7 has more to do with whether he wants to draw attention to his boss and probably lose the job.

I see it the reverse, myself. I see her as a resident of Washington state who is currently domiciled in VA. But if she will not owe anything if she files, I'd say go ahead and file just to avoid any question. Or have her mail go to Washington rather than VA.

You are distorting that, Jainen. The problem was in THE IRS RECORD, not in what was filed. His reports were filed correctly, the IRS thought there was no report filed becausre they were looking for it in the wrong place. And he did not get the notice because he does not get any mail there, not because he ignored it. -
The history screen was useful for things like an overlooked asset, where you need to use the 3115 to pick it up, etc. Or to compare to what was actually taken on a self-prepared return, for example. Not critical, but useful now and then.

Military members keep their Home State wherever they are stationed. But many [most?] states have special treatment for military wages. So that is where you should start your research. If he's a WV resident, how WV taxes his wages while deployed, depends on the state law. Every state I ever researched had a special link on their tax site for military.

If you have tried deleting the EIN and reentering it, and that did not work, your client is just stuck with being the victim of the IRS database error. You can try calling the efile help desk, but if they can not help you'r just stuck with paper filing.

The Internal Revenue Service has lifted a $79,064 tax lien on California Governor Arnold Schwarzenegger. A computer glitch in Schwarzenegger’s payroll tax records in 2004 and 2005 prompted the IRS to begin investigating the former action star and bodybuilder (see IRS Places $79,064 Lien on Schwarzenegger). The IRS placed the lien last May in the mistaken belief that Schwarzenegger had not paid payroll taxes for his household help when he actually had, according to the governor’s office. Schwarzenegger did not know until late last year that the IRS had been sending notices to his home instead of his office because he does not receive mail at home as a security precaution, according to the Associated Press. Schwarzenegger will still be assessed $20.50 for administrative fees, but that’s far less than the original lien of nearly $80,000. The IRS released the lien on Jan. 20, according to the San Francisco Chronicle.
