  1. Error keeps popping up inspite of checking 16b. Since 5405 is not approved for e-file. I dont know if anybody has brought to attention of IRS this problem

  3. EIC requires an individul to have social security number that allows them to work freely with any employer. If they did not have social security number and were using ITIN number, how is it that social security number issued them NOW makes them eligible for work in prior years. I totally agree with lucho, you cannot claim EIC for prior years but can be for current and future years.
  4. This is follow up to topic. I spoke to 2 different IRS agents from tax law group. Both of them confirmed this has to be shown as other ordinary income and increase in basis of property with same amount, if in case they have to repay this amount to amount some time in future before 3 years, then it could be written off against ordinary income.
  5. I just got down on phone with IRS practitioner's hotline. They want to me include in other income and increase basis of property and through this way want to match 1099-G amount. Local payer town told my client this will add to value of building and it is not income. I am confused. Can somebody point to any circular, memo regarding this.

Hello Everyone Have a client who received 1099-G from local town with 16K on line 6 Taxable Grants for improvements on commercial real estate with a rider from payer as long as they remain owners of this property for minimum of 3 years, they would not have to repay, if they decide to sell before this time they would pay them back with penalty. My understanding is this would be shown as other income and also increases basis of real estate, do we also have to show this as contingent liability if they decide to sell before 3 years ? thanks to all who responds

  8. Max 2009 IL 1040 cover letters advises to mail at IL dept of Rev, Springfiled, IL 62719-0001, whereas form IL-1040 says to mail at IL dept of Rev, PO Box 1040, Galesburg, IL 61402-1040. I would bring this to attention of ATX
  9. imjulier/Margaret Check to see if US employer has to comply with witholding rule about 28% from payment, since recipient is not US person or entity. I have a client who is not US Citizen or Resident has stock portfolio with brokerage firm, and brokerage firm withhold 28% of stock sale proceeds and remits to IRS, since he is not US person.
  10. Was that a supplementary card issued to daughter based on mother's existing card. In this case i believe mother is primary signatory and responsible for credit card debt even if daughter uses and dont pay for it. If mother allowed her good credit to be used as a guarantor to obtain credit card for daughter then in these circumstances also i believe mother is equally responsible as daugter not primarily though

I have a client who paid previous 3 years(2005/2006/2007) house property taxes arrears in current year i.e. 2008, he is insisting me to include in 2008 individual tax return schedule A, i advised him to amend previous 3 years and include each respective years taxes. Can somebody correct me if i am wrong thanks

  13. Respond with new 1099-Misc Copy A with corrected box checked on top with fishing proceeds box as 0.00, make sure you also file corrected 1096 if there is need
  14. Soc Sec & Medicare taxes were off by $22.00 & $5.00. I was able to fix it thanks

Friends I was able to catch the problem, it seems the person who were printing pay checks manually changed soc sec & medicare taxes for an employee for reasons best known to her, since then she has been advised to stay away, when the owner confronted her she claims it is quickbooks not her who changed the figures. thanks again to all who provided valuable suggestions

  17. Good evening everyone I am preparing 941 for a client who provided me payroll summary generated from quickbooks. Report shows employer's portion of social security and medicare taxes are more than employee's portion. Does anybody knows under what circumstances soc sec & medicare taxes varies for employee and employer
  18. SunTaxMan 1.For our discussion and currently yes NY client is only taxpayer's client. 2. Taxpayer currently thinks of providing software consulting services to only of his client based in NY & this corporation would solely be floated to use for these services 3.Taxpayer does not have nor does he intends to open an office in NY, would plan to use his home address in NJ as NJ domiciled corporation. Of course there would be payroll, my question is should he be subject to NY/NYC withholding & NY unemployment OR NJ I appreciate your responses
  19. Hello everybody I have a question hope someone will provide guidance. Have a client who resides in Edison, NJ would be commuting 70 miles both ways everyday to New york city for providing software consulting services. Client insists on floating NJ corporation, paying payroll taxes in NJ and at end of year would file NY non-resident & pay taxes, but i was inclined towards NY corporation and complying NY & NYC payroll taxes. thanks to all who responds
  20. JohnH I apologize for improper placement of words. All i was trying is find out what is the essence of drafting such a tax code. Is government trying to promote home buying/money borrowing and if so how is it different from each year, i.e. 2008 or 2009. I am sure this issue is definitely going to be raised by home buyers of 2008

I have this question posed to me by a client who bought house in june 2008 claimed $7,500.00 credit on individual tax return, they are subject to repayment of credit begining year 2010 for an amount of $500.00 every year until next 15 years, whereas taxpayers who bought houses in 2009 and stays for 36 months, repayment of loan is waived ? Does anybody knows what rational/logic was behind coming up with such a tax code
  22. Lion I dont think Revenue Procedure 2003-43 is any more acceptable. It should now be filed under Revenue Procedure 2004-48. Double check with IRS
  23. MAS Call to tax practitioner's hotline would not work. I had same problem when i try to talk to them, they IRS said I cannot represent client's dependent son or daughter since they dont have ITIN. My suggestion, You should fill out new w-7's along with notarized documents and attach a letter explaining the problem, make sure you attach copy of rejection and mail to address listed on that letter, i believe it should have a Texas IRS center address
  24. Jainen Trust is the essence (built in inherent requirement) of attorney/accountant-client privilege. Was wondering what those fraternity guys might have done for you to say something like this about them. Now client wants to have face to face discussion with attorney to finalize his choice of trust, otherwise i would have referred him to some attorney anywhere in US plus I have to coordinate all financial stuff with attorney
