  1. As I now understand it, if the child has a filing requirement, it must be included as part of their MAGI.
  2. This has been my experience for the past 4 years. Even then, unless you are an EA, CPA or Attorney, they will not discuss the return with you. This is the driving force for acquiring my EA. I am also considering having every client sign a 4868. Keep them in their file, then when an issue arises, I simply fax the form. Saves time, trips and playing phone tag.

  4. The IRS is not doing any verification of any ACA information for tax year 2014 EXCEPT those that receive 1095-A from the exchange. This comes from Karen Hawkins directly from her voice to my ear face to face in June 2014. Tax year 2015 will be different as the insurers AND employers with over 100 employees are required to send the appropriate 1095 forms. There will be a vehicle for the IRS to verify the information. Please note: The cutbacks at the IRS will severely inhibit their ability to do anything. I look for more computer generated mail audits and a HUGE spike in the number of CP2000 notices starting about 12 months from now.

  6. I use the Double Window envelopes designed to fit both W-2 and 1099. NOTE! The envelopes are different!! I use the format of two forms per page. Paper cutter easily splits them to fit in the envelopes.

  9. This is the reason I worked for 3 1/2 years to achieve my Enrolled Agent status. The IRS cannot tell me that I cannot discuss the return with me now. Before, even with 2848 & 8812, I was stonewalled. Especially prior years. NO MORE!! 2848 now give me the authority to talk to IRS about anything on the return. I am not sure how to handle the extra time involved to contact the IRS about a client. Contemplating - If it is an issue that is caused by careless or irresponsible action of the client, I will bill for the time. If it is caused by the IRS, I will also bill the client. Of course, if it is due to me or my actions in any way, I will not charge. I am quickly becoming hardened about moving the costs of these things to the client.

  11. I remember hearing or reading about a State that implemented a new deduction or credit for 2014. I cannot remember and I cannot find any information about it? Anyone with a sharp memory remember??

  13. Now I have been blocked from editing or removing my posts. SWEET!! Do you think that the IRS commissioner released that information for any other reason that political positioning and to make political points?? I am not that blind.
  14. Then don't post the political portion. It is IMPOSSIBLE to separate the actions of the IRS from politics. Excuse me for calling it like I see it.
  15. If the IRS will clean up its own house, the top 2 levels of administration, then Congress may see fit to allocate more funds. The IRS has shown repeatedly that is cannot use funds properly or efficiently. These cuts are due to the corruption at the top of the IRS. The only tool Congress has is to cut funding. It is very obvious that the Justice Department has been told to keep hands off any IRS person.
  16. Where is the reg that prohibits us from charging a separate fee for e-filing? I cannot locate it.
  17. Find the definition of MAGI as related to the Shared Responsibility Payment. THAT is the question. Note the term "modified AGI."
  18. The problem is that most that hear it will think that their refund comes from IRS money. That is the sad but true part of how "low information" our society has become.

  20. I am telling all clients to "Expect your refund to take 6 weeks or more." When they get them sooner, I am a hero. We must stem the tide of "gotta have my refund RIGHT NOW" thinking. I do not allow my clients to beat me up over time for receiving refunds. I have the phone numbers, mailing address and e-mail addresses of our Representatives and Senators to give to people with complaints. I do not make the laws. I do not create false returns to scam the government out of millions. I do not cause the ineptitude in the IRS.

  24. You must do the latest program update for 2013 in order for the organizer to be completely functional. Turning off automatic updates is a HUGE mistake on the prior year programs. I cannot imagine what reason you have for doing that? If you intend to e-file any 2013 or 2012 tax returns, you must also do the program updates for both years as well.
  25. There are people at ATX tech support, then there are also a FEW technicians at ATX tech support. The quality and reliability of tech support is abysmal at best. Once you complain loud enough, and tick off enough people, they will connect you with one of the FEW REAL technicians there. This is a sore point with me. Two full years ago, I heard the head of ATX say... "We are going to make changes to our phone system and database such that when a person calls that does not need the basic remedial help, they will be transferred to the upper level technicians." Just like always, management will say what sounds good, but only do what some desk flyer thinks is right. Since 2007, tech support has been a HUGE waste of time when I call. Currently, instead of calling, I blanket e-mail several people at the top. I have about 7 email addresses for people in the tech department and higher. Eventually, to get me off their back, they have a top tier tech call me. This way I don't stay on the phone for hours wasting my time while a 4th string CUSTOMER support person googles the problem and reads me answers. Rant over.
