  1. wow!! ........ "The scheme caused more than 8,000 fraudulent U.S. income tax returns to be filed, which sought more than $65 million in tax refunds and resulted in losses to the United States of more than $12 million." That is not good "The task force members then interacted with U.S. Postal Service employees in these hot spots and identified the characteristics of refund checks connected to the scheme. As a result of these efforts, more than $22 million in fraudulent tax refund checks that had been issued by the U.S. Treasury were not delivered to the conspirators or others, but were stopped by law enforcement officers." Well done!
  2. I really hope it will be the case.
  3. Agree with you, sec. 83b election is unavailable for restricted stock units or regular stock options, it is for restricted stock options. Thanks for the link lewis!
  4. Thank you, KC. Actually it is on form 8949 before Schedule D, and code 12 is "Expired granted option" but still I cannot find a better option to report sale of vested restricted stock units. My wonder actually is why should the taxpayer have to report this transaction on sch D at all, since as far as I understand RSU-s are treated as deffered compensation; or there is something within the ATX that I cannot understand or figure out. However, all I have from the client is one incomplete 1099-B form and no info about vesting date, MV on vesting date, fed tax paid!? ..... sounds weird .... Sounds like I will need more info from him, lol. Obviously it should not be reported on Line 21 as other income, no info on ATX KB too. I am a bit confused now so any help will be appreciated. Thanks again.
  5. Is is okay if I use code "12 - Exercised granted option" in ATX , to report RSU on Schedule D since I do not see a better choice. TIA
  6. I am sure all you know this website http://www.ptindirectory.com. Do not miss to visit it to update your listing and preserve your account before someone else does so ........
  7. TP is dual citizen and was receiving foreign unemployment benefits. Is this reportable and taxable 1040 income or? I was unable to find any info about foreign UB in the code. TIA
  8. Totally agree with Ed. Do not forget depreciation.
  9. That's correct. For 2012 the ATX program did not include the 1099C, but 2012 ATX Payroll module does.
  10. Absolutely correct. Yes, FICA and Medicare required, and while on an H1B visa, can use the substantial presence test to file a 1040, if test met. If was (and work) in US before 05/05/12 on one of the exempt visa status could be dual status. One of the benefits of using dual status is the fact that taxpayer can avail of tax treaty on non-resident part of the income. As the person is H1B Japanese national I think it wont be a problem if you send1040 to Austin with 7701 election. A bit tricky but could be assembled via ATX, I suppose with other softwares too.
  11. Any timid predictions about the length of the 'lapse in appropriations'? ....
  12. As usual. Everyone is resident for tax purposes even someone who is living and working abroad is required to file and report his world-wide income - from US and Japan in this case. Form 2555 is to claim FEC exclusion. Ask for all income, in US and Japan - pension, social, trusts, if renting his US residence, even interest on his Japanese bank account are reportable and could be taxable. Return can be e-filed or paper, depends on circumstances. Attach all US income statements but no Japan w-2 to the return. Don't forget FBAR and FATCA.
  13. Sorry, missed to clarify. TP is dual US-IE citizen with tax treaty on foreign SS benefits claimed on the return. Position disclosed on form 8833, amount of benefits listed. I just can't find out how to report them on 1040, as this Line 20 worksheet begins with "1. Enter the total amount from box 5 of all your forms SSA-1099", etc .... and there is no line saying Enter the total amount from all your forms with Foreign SS benefits, you know. Thanks for the feedback on overrides, ladies.
  14. First hand info. Due to the above mentioned reasons I kept putting off the update of the program for more than a month. Finally installed it and beside a single issue with one totally blank Fixed Assets Form on a completed return prepared with 12.13, I don't see other issues so far, single WinXP Pro SP3 installation.
  15. Hi folks, A quick one, ATX users orientated. How correctly to report in the software foreign social security benefits in case there is no such line on Line 20 (1040) - SS Benefits Worksheet. Every attempt to enter them manually or attach an Itemized List to the field, leads to an overriding note in check return functionality. Actually, is it incorrect overriding a field in case there is no other option to use!? Thanks for the tips in advance.

  17. http://www.irs.gov/Government-Entities/Indian-Tribal-Governments/Taxpayer-Identification-Number-(TIN)-On-Line-Matching - Taxpayer Identification Number (TIN) On-Line Matching TIN Matching is part of a suite of Internet based pre-filing e-services that allows “authorized payers” the opportunity to match 1099 payee information against IRS records prior to filing information returns. An authorized payer is one who has filed forms 1099-B ... And no prejudices, but if anyone have an idea why it was announced through the FSLG directory and when you hit the link you can see that the article was posted within the ITG directory!? .....
  18. You can use "Typewriter" functionality - it's both visible and printable. However as far as I know it is available only in Adobe Reader versions 8. (or 9.) and above.
  19. Useful feedback, thanks to everyone. Seems like both live seminars and webinars have their advantages and shortcomings and its normal. Since the list with an IRS approved CE provider is currently unavailable I am regularly checking the websites of my 2012 CE providers. I tried this, with FFA: http://fastforwardacademy.com/index-page-continuing-professional-education.htm This one I find it good too: http://www.eitc.irs.gov/rptoolkit/main/
  20. Lol, jainen, I find you very clever and nice guy. On the other hand, please read this article (there are other like this in the net), about the voluntary nature of the income tax and please share your thoughts with us again. Thank you. In the same time I'd like to clearly say, to all here on this board - please do not take this as an attempt of offence, however I was very confused, first time I have read this article ... Also the last thing I want is to bring some trouble to this board!, so Eric, please get rid off of my post as soon as you find it appropriate. Yet, I would be grateful if someone can share something else or just a different point of view about this foundation. Lastly, from my experience I can say that (it seems like) the only thing they care is a tax return to be filed and taxes paid. It does't matter if you are legal or illegal resident alien or citizen once you pay you tribute. Of course, it happens from time to time with them to issue an adjustment, rejection or owe money notice but as soon as the taxpayer whine "Oh no, I didn't knew it! (while I was e-filing with HRB or TurboTax and claiming the credits)! I am a non-resident!" and ... the rest you know it. rant over!
  21. Just curious, if anyone has so far come across ads for free CE credits in 2013? I suppose you all are well aware of current IRS requirements on the matter, anyway to keep in shape I am using a CE provider services occasionally and just saw their 2013 offer for free credits - passed the test, and credits were reported to the IRS on the same day. Nice one.

  24. I never thought that I'd be just the man who would say this but people, please chastened! Should I start to think that JohnH is the only normally thinking person on this board!? "Common sense, decency and respect are lost, not just in this forum, but in the general society in which we live." Yes. but aren't you, me, all we part of this society!? "Please moderate!" No. Please moderate but YOURSELF first! Democracy means freedom but not liberty! Freedom to control all you acts and behavior, but not freedom to do(write) whatever you want breaking all human (moral and ethic) rules. Do you think that Eric has nothing else to do but sit and moderate posts all day long!? Tom, please shut but do not lock the door! You know what I mean. Eric, two suggestions of mine, if you don't mind: except politics and religion, can you also think about 'sport' (another subject for which many people think they are world class specialists ) and 'relax area' for all the rest. Thank you! And (as JohnH said), me personally really do appreciate all your dedication to this forum (I've learned a lot here), and believe you can not afford to lose anyone. Otherwise, the rest you know - just ignore and "skip over when it gets silly" ...
  25. Hey Jack. http://myatx.blogspot.com/2013/05/1217-program-update-what-is-in-it-and.html - this is link with what's inside the update incl a list with items resolved in 12.17(due to 12.16 ) and one single functionality added. Any idea is it possible 12.16 to be built into 12.17!? As I haven't installed 12.16 so far, I don't find it very clever to run 12.17 too ... On another hand, a new feature allowing faster data entry on detail worksheets is not to be missed, but I'm afraid I might screw up the whole program ... and I don't find this portalsafe tool (wth is this and does anyone use it at all!?) very suitable and useful in my case.
