  1. The medal always has two side, you know .... I am amazed how most of you are surprised by TT experience! Haven't you tried before any free or trial version of such self-prepared tax return preparation softwares so far!? We do this every season at least to know to what we face and what to expect. Actually the main point here is that all these programs are softwares for self-prepared tax return - you know, that means no preparer, no fee, no extra spend. Remember this. Add IRS " ... it is the taxpayer who is ultimately responsible for all the information on the tax return." and we get the clear picture. Your can read about the miraculous "nonprofit coalition of industry-leading tax software companies partnered with the IRS" here and here.
  2. Totaly agree. One of those visas who do not exclude days of precense for the purpose of SPT. Check last 3 years of precense in US - could be 1040 even if lees than 183 in tax year. http://www.irs.gov/Individuals/International-Taxpayers/Alien-Residency-Examples- see Example 5
  3. NY info http://www.tax.ny.gov/pit/credits/more_income_tax_credits.htm
  4. I also hope that this won't be so, Jack, but what about this: http://www.irs.gov/Refunds/Nonresident-Aliens-Filing-Form-1040NR-for-Refund-of-U.S.-Source-Income-Withheld "If you are filing a Form 1040-NR, (U.S. Nonresident Alien Income Tax Return) and requesting a refund of tax withheld on a Form 1042-S, (Foreign Person's U.S. Source Income Subject to Withholding), we will need additional time to process your refund. Please allow up to 6 months from the return’s due date, or filing date if later, for your refund to be processed." Same or similar reasonable official explanation again could be "identify and verify data", but I doubt there will be some meaningful consequences in result of this .....

    ACA EXEMPTION

Totally agree with Judy here. I don't think there is any discrepancy in the info. The IRS site says: "Marketplace Exemptions ... If you claim the exemption on your return, you do not need an ECN from the Marketplace." and a table below: "Exemptions - Coverage is considered unaffordable - May only be caimed on the tax return" Page last updated - 12-Jan-2015 I think, as usual , it is in the way it was written and in the way you read it. I would say "You must apply for this exemption" shall be read as "You must apply for this exemption (via your tax return)" http://obamacarefacts.com/obamacare-mandate-exemption-penalty/ http://www.gpo.gov/fdsys/pkg/FR-2013-07-01/pdf/2013-15530.pdf- are these really final ones?

    Pub 17

Ha-ha-ha Okay, Jack. Thanks - i could give it a try, but that is not the point you know. "It's the principal of the thing." Sometimes I don't like their way of "cutting losses" Or I may try with Tax Books. Happy New Year to all!
  7. Hi there. More info needed. Try these 2) She spent six months in VA and six months in Canada. Does she need to file with VA State, for both 2013 and 2014? - http://www.tax.virginia.gov/site.cfm?alias=FilingRequirements 3) Where do I need to report the payment of Statement of Survivor Annuity Paid ? - http://apps.opm.gov/tax_calc/index.cfm http://www.irs.gov/pub/irs-pdf/p721.pdf- seems like whether the annuity reported on Form CSF 1099R is taxable or not it depends on whether and/or how long ago the beneficiary got retired. Hope this could be of any help.

    Pub 17

Veery disappointed too. I ordered publications some time ago to find out there will be no Pub 17 on paper. I also downloaded it but will not print it at all, since such papers ends lost somewhere on my desk .... and I have to print them again. no way
  9. Very profitable job indeed, based on the income - job related expenses graph - "have filed more than 8,000 fraudulent U.S. income tax returns seeking more than $65 million in tax refunds" and "five years in prison and a $250,000 fine for the conspiracy charge and up to 10 years in prison and a $250,000 fine for the theft of government property" ...
  10. Wow, it is funny how many comments such a simple and burden-less summer topic can accumulate though... I am young enough but there is one thing I learned and stick to. Don't judge people - there is one who can! But help them, give them the light, spread the knowledge amongst them and show them the right path and devote to Good. Do advise people - the responsibility for their actions and choices is their own! I am not CPA, (still) not EA, just a RTRP, but I definitely "liked the idea" because there is much truth within, and I completely agree with "My guess is it happens all the time. And people get away with it. I think a great number of them also receive entitlements." and I definitely do/will not give such advices to anyone for sure! Tongue in cheek. Lol, Jack, you're a real menace ..... worse than the c0mmuni$t$, lol
  11. I am sure it is useless to ask, Jack, but did you compare both sets of figures as they advised, you know ... could this be a hunting for unreported income ... https://www.ftb.ca.gov/aboutFTB/Public_Service_Bulletins/2013/Bulletin_1324.shtml https://www.ftb.ca.gov/law/meetings/attachments/120413/5a.pdf
  12. ... and it will never happen again ... for sure ..... But Brazilians could blame on themselves only. This is as a lesson for everyone - even if you are the Host of the football World Cup Finals. The larger the bubble, the more loudly and painful cracking. They had more to lose in the quarterfinals of Columbia and everything would be fine for them, alas ......
  13. Well now "Oh well, it's only soccer." But not exactly! Good games indeed. A squad, which any football fan in the world could be proud of!
  14. I might be wrong, but wasn't there some password reset .... on every 90 days!? ....
  15. He-he, yeah, you were almost right, Mas! Did you watch the match between Germany and Ghana .... The Devil is not so dark, local saying ... One more good game, same like previous two, and you will have the door open for you. You know, Jurgen Klinsmann was one of the greatest players of his time, very good and intelligent man, so USA soccer team definitely is on the right path, my friend! Good luck!
  16. For all interested and those who watched this game Congrats on first play - first win! http://usatq.files.wordpress.com/2014/06/usp_soccer__world_cup-ghana_vs_usa_65074104.jpg?w=640&h=433
  17. Absolutely agree with Pacun, and support all his posts on this case. Indeed, there is some level of guiltiness, but as I said, violating immigration law does not prevent someone from getting his tax affairs done. "First, limit yourself to prepare their taxes geting them the biggest refund legally possible or reducing their tax liablity as much as it is legally possible." "If you they decide to file jointly, you list her first on the return and list the husband second with his ITIN. Since he has been here in the US, you do't have to do anything special." "... to marry someone who (maybe) is looking for a green card ..." "In that case, if the both agree to file joint returns, they have to send a statement with their 1040 stating that they want the non-resident spouse wants to be treated as a U.S. resident for tax purposes ..." I start to think, that your client knows well what he "forgot" to do in 2013 and what they need to do now - they just need some help in preparing taxes.
  18. You definitely need to know residency and visa status as of 31/12/2013. At least you know filing status :-) .... I doubt he'll be able to claim dependent. There is no such "illegal alien" when talking about collecting taxes by the Federal agencies ..... Treated as a citizen of the country on a general basis and that's it
  19. http://www.accountingtoday.com/news/Chiropractor-Arrested-Bribing-IRS-Auditor-69630-1.html?utm_campaign=tax%20pro%20today-feb%2019%202014&utm_medium=email&utm_source=newsletter&taxpro=1 - A chiropractor has been arrested for attempting to bribe an Internal Revenue Service auditor who questioned deductions the chiropractor had claimed for payments to two female patients who had accused him of inappropriately touching them. Speechless. And priceless.... for everything else there's .....
  20. So to add my humble oppinion though I see you already found it - for MFJ filesr, both should have earned income for DCE credit. From instructions to the form: '"Lines 4 and 5 If filing jointly, figure your and your spouse's earned income separately. Enter your earned income on line 4 and your spouse's earned income on line 5. Earned income for figuring the credit includes the following amounts. 1. The amount shown on Form 1040, line 7; Form 1040A, line 7; or Form 1040NR, line 8; minus any amount: a. Included for a scholarship or fellowship grant that was not reported to you on a Form W-2" There is also: "If You or Your Spouse Was a Student or DisabledYour spouse's earned income. Your spouse was a full-time student if he or she was enrolled as a full-time student at a school for some part of each of 5 calendar months during 2013. The months need not be consecutive. A school does not include an on-the-job training course, correspondence school, or a school offering courses only through the Internet. Your spouse was disabled if he or she was not physically or mentally capable of self-care. Figure your spouse's earned income on a monthly basis. For each month or part of a month your spouse was a student or was disabled, he or she is considered to have worked and earned income. His or her earned income for each month is considered to be at least $250 ($500 if more than one qualifying person was cared for in 2013). Enter that amount on line 5. If your spouse also worked during that month, use the higher of $250 (or $500) or his or her actual earned income for that month. For any month that your spouse was not a student or disabled, use your spouse's actual earned income if he or she worked during the month." AFA I understood, he's not "full-time student" so for me case closed.
  21. http://www.ssa.gov/international/Agreement_Pamphlets/spain.html http://www.ssa.gov/international/Agreement_Texts/spanish.html - The agreement itself http://www.irs.gov/Individuals/International-Taxpayers/Foreign-Student-Liability-for-Social-Security-and-Medicare-Taxes - "The United States has entered into agreements with several nations called TOTALIZATION AGREEMENTS for the purpose of avoiding double taxation of income with respect to social security taxes." As far as I see, taxes here are already paid. http://www.irs.gov/Individuals/International-Taxpayers/Exempt-Individuals-Teachers-and-Trainees You cannot claim FICA refund on form 1040X. http://www.irs.gov/pub/irs-pdf/i843.pdf Usually, unis provide a lot of info on this.
  22. Windows+D = Show Desktop; most used by me combo these days, especially for Win7 users I suppose you know the other - Ctrl+A, Ctrl+S, +Z, +X, +C, +V, +B, +U, +N, +T Marry Christmass and Happy New Year!!
  23. It is visible from an airplane, both receipts have been written by different persons. A simple graphological test will show that one of them is not telling the truth .....
  24. "DItto. And to make it even more galling, they continue to send me promotional material (despite several requests to be removed from their marketing list)." The key is to ignore the message. They use these emails to check the recipients. If you send them unsubscribe request they will only know that you are using this inbox regularly and will continue to pester you. I got one message in May from them. I have TRX, TaxExact and Taxes R Us in my blacklist.
  25. Sorted out. The client has missed! to provide the vesting schedule, where all vested/sold shares for the year are listed. Ended up with short term capital loss.
