  1. Client is not from NY...I said "a taxless state". Client is from WA....silicon valley guy
  2. Dear Client- I have a major PITA every year...and this year you get the award. The award is that I will absolutely not do your return in the future. You live in a "taxless state". You have 1 W-2. Your wife has a T-Shirt business...which is a joke. But, every year you give me a spreadsheet...as if it's a thriving enterprise. There's always a loss. I know you have an MBA from Wharton...and you know all about COGS etc. But really, she sells 5 shirts and travels 3600 miles to do this. She spent $2540 to repair a 3 year old computer. And your list goes on. But...dear client...I have warned you that this return looks ridiculous...especially because your W-2 is for $250,000. In addition...you send me the W-2 on 1/24..with the spreadsheet...but don't get back to me until 3/24. So...when you ask me questions...I really do not remember why I did what I did 2 months ago so that your return would not look frivolous. You have too many years of loses. I am not going to get fined because you're an idiot. I don't care if her business is registered with the state and you paid a fee. BTW...if you have one more critique of this return....I will refuse to file it. Otherwise....just send me my check...and find someone new next year.
  3. Feel better....take a few days an do nothing
  4. Oh....I meant he lives in TX and needs a partnership. I don't know if TX has a filing requirement.
  5. I have a client who needs a TX partnership. I have personal return ready "to go"...and then he mentions a partnership...and I told him that's a separate return. He went to his local Liberty...and told him that he already filed. They offered to do the partnership and amend the return (he didn't really file) for $100...which seems extremely cheap. However, they may assume his 1040 is one W-2...which it isn't. Anyway...I told him that imho....I wouldn't trust Liberty. To the point (I'm sure he paid more than $100...just not hundreds and hundreds)....if anyone is interested, please PM me. According to him there are 2 partners...and 2 transactions for the entire year. Thanks.........
  6. When I got an ipad I asked TaxAct if I could use the software on it. "No"! Not that I would to prepare a tax return...but I thought for travel purposes...if someone asked me a question...I'd have the return with me.
  7. I'd file and amend if it's going to be a long wait. I do that sometimes for ITIN applicants...so they get part of their refund
  8. "Applied For".....will be rejected. It's easier to wait for the SS# and e-file.
  9. If he were a voice-over, or broadcaster, or actor....would you give it to him? I don't see much of a difference. His voice is his living. I would tell him to document the lisp. I'd classify it as "professional maintenance".
  10. Mine did. I told him that I'm a special agent with the IRS and I was having his call traced.
  11. As it turns out....I don't know where her statement came from. The "$100 bucks" probably meant he paid H&R $100. The difference between MFS and MFJ was only about $500 federal. DH had lots of withholding...so he only owed about $500. Jointly...they owed about $7500 because she had "next to nothing withheld". So...DH had been carrying her all these years.
  12. Not really over-worrying....just uninformed (I haven't had an NOL in years)....and not trusting my research. I think I did recently with something else (tp in China..can mom still be dependent)....I'm looking for the negative....more work for me answer. Oh...I miss the days when I could call IRS...ask a question...get an answer and a badge number!
  13. He made the election...... I figured it all out....he has this huge loss (because wash sales don't count) on his short term day trading. I did separate his "traditional trading" from his "day trading"....... And yes John, I agree....he will be back working security before this is over. According to "the rules" he's supposed to trade 75 days/year...which I told him (and he seemed to know)....just as a warning that he may think he's a day trader...but the IRS may disagree.

    NOL

Relating to the day trader....and something else I rarely do.... Just want to confirm I'm doing it right.... So...as a day trader....wash sales don't apply He has a $500,000 NOL I am not electing to carry back. My software is just printing a statement that he elects to not carry-back. Is there any form about carry-forward...or is that automatic. Thanks........
  15. Thanks...but that's not the issue. The short term trading is fine. It's the long term...and he's giving me bs. In about an hour I'm gonna tell him: "Your 1099-B very clearly shows that you bought FNMA in 2009. it clearly shows you sold it in 2014....at a gain of $140,000. You gotta pay the tax." And when his response is "No because blah blah blah...." I'll direct him to H&R. I thought there was maybe some hidden rule......but I know he wasn't a trader in 2009 (I did his return a few years ago...and he was a security guard,)
  16. A returning client from years ago: He became a day trader. However on his 1099-B he has long term gains of $140,000. Of course he's giving me this bs about "blah blah blah"....it's Line E. In doing my research...I don't see any reason why it isn't long term gains. Day trading (he is an official day trader) is something I have no experience in. Anybody know about this???
  17. I told her that was impossible...and I'd really like to see his return. I think she wants me to "figure it out" and then decide. But...if she sends it to me...unless it's super simple...I'll tell her to pay in advance. How can intelligent people like us compete with H&R?????
  18. New client today,,,,, She wants to file separately. She made about $110,000...and owes $6000. She told me her husband already filed...because she was away. Her husband made about $150,000. She was very upset...so I told her that I could amend the husband's return to include her...and everyone would be better off. Here's her response: Can you check and let me know how much we would owe if filed together ? This would helps us decide if we really want a tax amendment. The reason I say so is because my husband informed me that while filling his tax return with H&R block he was also offered this option of filling jointly but the amount came to $7500 so he went ahead and filed separately paying just 100 bucks. Thanks
  19. All the states need to be reported....all had withholding. There are probably more than 9....FL, TX, WA etc......
  20. As an NR...you never file joint and you never have dependents (a few exceptions...but not from Spain). You also have to itemize. So...if he amended it...he probably would owe. If he plans on getting a Green Card...they want to see past tax returns....so it could be problematic. Sometimes there are issues when the person leaves the US. He was supposed to file the 1040-NR in 2013...and if the IRS told him to amend 2013....they may follow-up.
  21. It's 2 years as an non-resident for a J-1.
  22. Client has one W-2 with 9 states. My program can't handle this . If anybody wants it....please pm me. Va. Ct. Mi ca ms pa il ny me Sorry....my internet is down and I'm doing this from an iPad ....that's why I didn't put the states in capitals.
  23. She did....and that person said "C'mon down"
  24. Mine tried...but it said "couldn't verify identity" when she entered her address. She didn't even get to the part about "What color was the car you bought int 1995?"
  25. My client got one. It took her a day or two to reach someone. She has to,go to the IRS office with photo ID and her W-2....and a copy of the tax return.
