I reported to ATX that on page 8 under NOL information, the program is picking up the same amounts for carryover to this year and to future years.

I dont need the form i need the option to attach it to the return. the instructions for attaching a form state to go to efile menue and click on "attachment to 1120/990/1065" that option isnt in the program this year. There is only an option to attach a pdf but this isnt a pdf its a tax form schedule

a red error says i need to attach the NY CT-399 form the e-file menue but i don't have that option this year. it is there on 2008 program. Anyone else not have have this option this year?

does NY accept a late s-election like the IRS does?

i have used the same proceedure for NY and have had it accepted. They will ask for a copy of th efederal election. i usually say there was a mixup whether the client, attorney or cpa was going to file the election with each thinking the other was doing it. Make sure any individual returns are filed as if the s was in effect which further shows intent! -
got a new guy that purchased a route in a corp. Is there anything i special i need to know for this sort of business? He already has a few other drivers that he put on payroll. To me it seems a straight forward business but i thought i'd check here.

my post isn't a critism of you or your doing the best for your clients. i am truly curious, maybe since its only my second year of efiling but i do not understand why it is so important to get an efile accepted. even here in NY where it is mandatory, i just tell the client that the efile isn't going through and have then sign an opt-out form. I see people here posting about the same return for 3 days, in my mind they could have paper filed it already and the refund would be that much sooner.

if you are spending so much time with a minor issue like this and hours on hold, why not just paper file instead of filing and planning to amend later on? What am i missing? If i get a return rejected and i can't fix it in 1-2 tries i paper file it. [of course if you do dozens of these returns you might want to get the efile working but why waste so much time on one return?]

client copy watermark inconsistencies

i contacted atx about this last week but haven't received a response yet -
I do not give my clients a signed copy for their records, sometimes a client copy may include items not sent to the government, ie depreciation schedule etc. If they need a signed copy for something, i would rather send one to them at that time. That way besides knowing the receipent got just what the governemnt received i also know what the client is up to during the year, ie buying property, getting divorced, etc.

bravely i disagree with Jainen [i am in NY] i once had a restaurant who would fax me 50 copies of his daily specials, using up my fax tonor and paper [many years ago]. he told me he bought the machine used and didn't know why my number was programed into it like that. Well after a few weeks of his "trying to fix it" i called the phone company and they told me to go to the police that unwanted and excessive phone calls are considered harassment [again i am in ny]. the first cop told me what you did but i asked for his sargent who agreed with me, sent an officer to my office. He actually gave me the option of letting him scare the restrantaur or arresting him for harassment. [i had the printouts and the recording of my conversations asking him to stop the faxes] i opted to just let the cop scare him. the cop went to the restaurant and told the guy he was guilty of harassment and he had one more day to correct the fax machine or he would get arrested. the restrant guy took the machine in front of the cop and tossed it in the dumpster!

Depreciation is his since you must give him worksheets that adjusted his numbers. most other worksheets are yours. do you have caller id that shows a log of calls? if not buy one at radio shack for about $10 then go to the police and charge him with harassment. That many calls qualify, also large a complaint with the phone company. Once he gets a call from the phone co and the police investigating your complaint i bet he disappears. i would also sue him in small claims court and have him served with a process server at his home or work or anywhere he will be publically embarrassed. Mailing your invoice with a big "past due" stamp on the outside works too. if he is harassing you then you harass him back [legally] till he goes away. someone on the old board once gave me a great idea that i used once. With your invoice, let it be known that if you aren't paid in 1 week you will notify the irs to remove your name as paid preparer of his work since you were never paid. my letter stated that you are dooing this to protect yourself and have no idea if it will open his return to further scrutany by the irs.[a subtle threat]

we all should be flooding atx with complaints, an efile authorization form which only stays in our files isn't available and the estimated date keeps getting pushed back, i repeat this form just stay in our files. THE TAX RETURN IS MANDATORY TO BE EFILED AND IS DUE 1/30!!!!!!!!!! "TR-579-PT"

"I always add it to the Wages entry on the 4th quarter 941 (but not to SocSec/Med wages), because I want the sum of all lines of all 4 of the 941's to agree with the sum of all boxes of the W-2's" [wish i learned how to use the quote function here" thanks all and John does have my question right but many times the wages on a tax return do not match the w-2's or 941's. items like aflac withheld do not get reported anywhere and the w-2/941 is just the net amount. thats why we were confused about this item. Old Jacks answer from the 1120s instructions that the insurance is subject to withholding answers the question, that is should go on the 941's. No where did i see that in the w-2 instrucitons or the irs publication on benefits etc. thanks all!!

these are due 1/30 and atx still hasn't released the efile authorization form. I have no problem waiting another week to actualy efile the form but i need to start gathering the clients signatures [over 300 of them]. what do you think if i use the 2008 form and just change the year? this form does not go to the government but just stays in my file incase NY inspectors stop by. Even though it sounds mickey mouse and unprofessional i can get the clients to resign the correct form when i prepare there partnership returns.

Doesn't patter what the premium is based on. a 2% shareholder of an s corp needs to have the cost of his insurance on their w-2, just not sure if it goes on the 941 too.

my office is in total disagreement. does the insurance go just on the w-2 or do you add it to the 4th quarter 941 too?

you have to put it in manually each time-real pain if you use another system for invoicing like quickbooks for your monthly clients etc. I just keep a scratch pad on my desk with the next number to use.

in NY i have had experiences like this and a letter that the entity was formed but never funded and shares never issued will end the issue, epecially with the irs and tax penalties usually don't pass through to the shareholder for corporate taxes unless the shareholder received benifit from the company
