  1. The problem is not usually with the REAL census takers, it's with the con artists that use the census as a means to trick people.

You all might be interested in the column in today's Wall Street Journal that points out that several penalties in the Code will be converted to "strict liability" (that is, the IRS will have no discretion to abate them for reasonable cause) in order to pay for the health care plan (the changes being right there in the health care bill's revenue provisions). Let me suggest, that our clients are going to be looking closely to us for reimbursment when we can no longer get them off the hook. Does this make you happy? Our kinder, gentler Administration and Congress hard at work...and saving American lives, no less. But then I guess whatever burden we wil bear is worth it, huh? Want to discuss this with your representatives and senators?
  3. You may not need to file the petition, but get it ready and file it timely if you do not get this cleared up BEFORE the filing deadline. Odds are good if the process just started that you can get it sorted out without actually filing the petition, but if you are within 45 days of the deadline you can not expect to get it 'fixed' in time, so should file anyway. But if you are just at the start of the 90 days, by all means try to work with them now. Just don't trust them to keep to any 'promise' made by someone on the phone, to the point that you miss the deadline.

  7. Yes, the easiest way would be to add the assets as they should have been, then delete the old asset listings. Actually, that is how I go about determining the 3115 adjustments, is by copying the return, adding the corrected assets and deleting the old ones, and looking at the differences in the History view of the assets.
  8. I'd just say that if while it is their call whether they amend, [i'm guessing they don't even come back] I would not do any year unless they agree to amend all the fraudulent returns. Because I would not want the problems that are likely to occur. Frankly, these people knew they were cheating and filing false returns, and now they only want to get some more 'free money' from the IRS. I suspect that they got more than 8K from the bogus EITC over those years.

I think one of the big misconceptions around is that conservatives think the healthcare system is fine, and liberals think it's terrible. In fact, most of all of us think that there are lots of things that need fixing, we just disagree about the methods that will do the best job of fixing them. And, of course, some of us are horrified at the idea of getting the IRS involved in the process.

  13. I am a bit confused by your question, or actually by the vast amount of information omitted. I'm really not at all sure what you are asking. But I'll take a stab at it by answering what I think you might be asking. If you are asking about how you report the extra depreciation, after using a 3115 to calculate it, the answer is that it goes on the C or F or E or 1065 or 1120S, etc, on the 'other deductions' line, with the description being "Depreciation from Form 3115".
  14. There has always been some bias, no doubt, but I've never seen such a totally outrageous example as this one, where the film was so totally edited to present a lie as fact.
  15. Helping people is mostly what churches do. And it;s not income to the recipient, nor limited in amount. As long as the church is giving the money, and the recipients are not employees or related to employees, simply people the church has identified as people in need, there are no restrictions.

    It is income, but it may not be self-employment income. The test for that is whether the grandparents are actively in the trade or business of providing child care. There was a recent case where grandparents prevailed when paid by the state of Illinois to take care of the grandchild so their daughter could work and the Tax Court specifically held it was not self-employment income despite IRS claims to the contrary. If they only take care of the grandchild and haven't previously taken care of children, I suspect you could make the case it's not self-employment income. While it's not a Tax Court case, note that Rev. Rul. 58-5 concludes that "usually" a person acting as the personal representative for a close friend or relative is not subject to self-employment tax. The case referred to above was Steele v. Commissioner, TC Summary 2009-45. Obviously not precedential, but I believe the analysis still holds--§1402 requires the active conduct of a trade or business and the Court concluded that simply wasn't the case here.     I think that the land should be shown on the books as well as on the tax books. In other words, it should be shown the same for financial reports and tax reports.

The IRS is providing the following information to alert taxpayers on being careful when dealing with those claiming to be a census taker. 2010 U.S. Census Cautions to avoid Fraud or Identity Theft With the U.S. Census process beginning, the Better Business Bureau (BBB) advises people to be cooperative, but cautious, so as not to become a victim of fraud or identity theft. The first phase of the 2010 U.S. Census is under way as workers have begun verifying the addresses of households across the country. Eventually, more than 140,000 U.S. Census workers will count every person in the United States and will gather information about every person living at each address including name, age, gender, race, and other relevant data. The big question is - how do you tell the difference between a U.S. Census worker and a con artist? BBB offers the following advice: A. If a U.S. Census worker knocks on your door, they will have a badge, a handheld device, a Census Bureau canvas bag, and a confidentiality notice. Ask to see their identification and their badge before answering their questions. However, you should never invite anyone you don't know into your home. B. Census workers are currently only knocking on doors to verify address information. Do not give your Social Security number, credit card or banking information to anyone, even if they claim they need it for the U.S. Census. While the Census Bureau might ask for basic financial information, such as a salary range, it will not ask for Social Security, bank account, or credit card numbers nor will employees solicit donations. Eventually, Census workers may contact you by telephone, mail, or in person at home. However, they will not contact you by Email, so be on the lookout for Email scams impersonating the Census. Never click on a link or open any attachments in an Email that are supposedly from the U.S. Census Bureau. For more advice on avoiding identity theft and fraud, visit www.bbb.org.
  22. Why did the president compare ObamaCare to the post office? Maybe because the reality would be even worse. Blogger William Jacobson, a Cornell law professor, notes that under the House and Senate ObamaCare bills, the Internal Revenue Service would "play a key role in monitoring and enforcing health care mandates against individual taxpayers": These reporting provisions would allow the IRS to cross-check income tax returns and health coverage filings, and withhold tax refunds or utilize other collection methods for persons who do not have coverage unless they can prove they have acceptable coverage from some other source. This is similar to the cross-checking the IRS does on income reported separately by the person making the payment and the taxpayer receiving the payment. But for the first time the IRS is not checking for income to tax, but for lack of health coverage. These provisions should have people interested in privacy greatly concerned. While income information already is reported to the IRS, the IRS traditionally has not received personal health care information about individuals. They say death and taxes are inevitable. If President Obama has his way, we'll have one-stop shopping. And knowing how the IRS never makes mistakes when cross-matching, that does not scare us, right?

While ideally they should, as mentioned, check then uncheck EVERY SINGLE BOX, in fact, the tax program is today, so very complex, and so large, and has such a short time line to be completed and installed, that it's really impossible to do that unless you charge those huge prices so that you can hire tons of testers. And since the tax code is often, these days, changed up to late Dec, the testers do have lots of other things to test that happen often, first.
  24. Not to mention all the 'empty nesters' that now have only their pets for companionship. Hey, how about HOH status for anyone with three or more pets?
  25. Just be sure that your cover letter spells out exactly what returns are included, and include an extra copy and ask that they stamp it "Received" and return the copy to you. That decreased the odds that any of the returns get stapled to another year, and over-looked. And gives you proof if anything later gets questioned about timing, etc.
