    If line 61 was checked, then don't worry and amend later if needed. Let the process go flawless and when the client receives the refund, then talk about amending. This makes me think about this: What's better, to find your own practice's mistake and be worried about them, or never know about your mistakes or potential mistakes and drink your margaritas or wine happily?

  7. I always send multiple returns in one envelope. This one will needs to be in one envelope so your explanation makes sense. I have noticed that government agencies keep even the envelopes and they are not allowed to throw anything that it is received. Yes, sometimes they misplaced them but hey, how many times we have misplaced W-2 and it takes a big effort to find them? Make sure you list the years you are filing on the letter. I thought your question was going to be "Who is going to sign the returns"?
  8. You have a family of unmarried parents and 6 children. All US citizens and all the income came from W-2. They lived in the same household the whole year 2014 and none of the children provided more than 50% of their own support. Ages of children and W2 income: Child 1, age 19 and made 23k, not going to school at all child 2, age 20 (was a full time student for one semester in 2014) made 25K Child 3, age18 and made only 2K Child 4, Age 17 and made 15K Child 5, Age 30, Complete and permanent disable but he appeared on a movie and made $40K Child 6, Age 26 made 24K and was a full time student at the local University. unmarried father made 5K income but it was enough money to go solo to Las Vegas for a whole week in 2014. Mother made 4K income. Everybody wants to claim child 3 as a dependent and if possible claim EIC. The family wants to do everything legal and wants the child to be claimed by the person who legally can benefit the most following the rules. Once you have suggested who will claim the child, the other After you have decided to claim EIC by the person who will legally benefit the most, how will you answer this questions: "Is the child you are claiming a qualified child of another person" "What the relationship between your dependent and the other person" "will you win the tie breaker" Can you list the people in the order that they will win the tie breaker if they all claim child 3?   11. No. I think that as long as the university participates on the Financial Aid program run by the US Department of Education, they are OK. So, why will you take the credit if you will have to recalculate the credit?
  12. You have to answer it yes and since you know the father will not claim him/her, you will win the tie breaker. The tie breaker ONLY applies if two people claim the same child.

  15. Without knowing the situation at Starbucks, I will explain my situation and make your deductions. I was taking classes for a Masters and my company reimbursed me 100% for As and 80% for Bs, to the maximum allowed by the IRS which was $5,250 for 2014. So, I would take only 1 class per semester because the cost per class was about $2500. So, I would not qualify for any education credits on my 1040 because I didn't pay anything from my pocket... but my education was fully paid by my company tax free to me. If I decided to take two classes each semester, then I would pay $10,000 to school and my employer would only reimburse me only $5,250 tax free and the rest would be added to my W-2. If I paid 10K, then I could use $4,750 for tax credits. That would be true if the employer reimburse me after $5,250 or I paid from my funds. Legal challenge... You go to school knowing that the company will reimburse you and you spend 5K in 2014 but the company's slow process refunds you in June 2015. Technically you could claim AOC and then later on add that amount to your salary and pay taxes for it. I read somewhere that you also have to return the benefit from the money you receive in later years or you must amend 2014.
  16. You have it correct. No one will be able to claim HOH and no need for the extra worksheet and questions.
  17. You got the correct answer from Frazzled, mom as single or HOH if she qualifies and father as single. Or father as HOH (if he qualifies) with the dependent child and mother as single without the child as a dependent and no benefits. The only time I have seen one filing as HOH and claiming EIC without claiming the child is in the case of separated parents. One parent lives with the child all year and provides more than half of the support, get HOH and EIC and signs the dependent release form so the absent parent can claim the child.

  21. I think this happens to all of us. When a TP makes a stupid mistake (in this case he had to wait less than 15 days), you hope you misread something and you wish that someone will tell you that you are wrong and that's why you post the question. Ironically this person didn't need the money until late November. I told him he had to pay the penalty.

    It seems that you check line 61 on form 1040 for the Husband and open form 8965 for the wife. This is the situation. Husband made 100K and had insurance for the whole 2014. Wife has ITIN and is exempted. Can line 61 be checked and invoke form 8965 for wife?
  24. That makes sense. I forgot the requirements from the IRS to the EROs and they have to follow the IRS rules imposed on them.
